Assembly Concurrent RESOLUTION—Directing the Legislative Commission to conduct an interim study concerning misdemeanors.

 

1-1     Whereas, During the 1995 Legislative Session, legislation was enacted

1-2  to provide categories for felonies; and

1-3     Whereas, The Nevada Revised Statutes currently provides for only

1-4  two categories of misdemeanors that are designated as misdemeanors and

1-5  gross misdemeanors; and

1-6     Whereas, A study needs to be conducted to determine whether

1-7  providing categories for misdemeanors and penalties commensurate with

1-8  those categories would provide more consistency in the criminal statutory

1-9  scheme; now, therefore, be it

1-10     Resolved by the Assembly of the State of Nevada, the Senate

1-11  Concurring, That the Legislative Commission is hereby directed to

1-12  appoint a committee consisting of three members of the Assembly, two of

1-13  whom are members of the Assembly Standing Committee on Judiciary and

1-14  three members of the Senate, two of whom are members of the Senate

1-15  Standing Committee on Judiciary, to conduct an interim study concerning

1-16  misdemeanors; and be it further

1-17     Resolved, That the study must include, without limitation, an analysis

1-18  of:

1-19    1.  The existing statutes concerning misdemeanors to determine

1-20  whether it is feasible to categorize misdemeanors and provide penalties

1-21  commensurate with the categorization;

1-22    2.  Whether it is beneficial to amend the Nevada Revised Statutes to

1-23  categorize misdemeanors in such a manner;

1-24    3.  The effect that categorizing misdemeanors in such a manner would

1-25  have on the courts of this state, including, without limitation, any increase

1-26  in the volume of cases handled by the courts and any necessary changes to

1-27  the jurisdiction of the lower courts; and

1-28    4.  Any other matter related to misdemeanors, as deemed necessary by

1-29  the committee; and be it further


2-1     Resolved, That any recommended legislation proposed by the

2-2  committee must be approved by a majority of the members of the Senate

2-3  and a majority of the members of the Assembly appointed to the

2-4  committee; and be it further

2-5     Resolved, That the Legislative Commission shall submit a report of

2-6  the results of the study and any recommendations for legislation to the

2-7  72nd session of the Nevada Legislature.
