AN ACT making an appropriation to the Interim Finance Committee to provide assistance to certain educational programs; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. There is hereby appropriated from the state general
1-2 fund to the Interim Finance Committee the sum of $5,000,000 for
1-3 allocations to existing educational programs that are at risk of termination
1-4 because of a lack of funding.
1-5 2. The money appropriated by subsection 1 may only be allocated to
1-6 an existing educational program if all other sources of funding for the
1-7 existing educational program that have been appropriated by the
1-8 Legislature have been exhausted by the requesting program. Money
1-9 allocated pursuant to this section must not be used to negotiate the salaries
1-10 of educational personnel.
1-11 3. The State Board of Examiners shall adopt policies, procedures and
1-12 criteria for the review of requests for allocations pursuant to subsection 4.
1-13 Upon the adoption of such policies, procedures and criteria, the State
1-14 Board of Examiners shall transmit a copy of the policies, procedures and
1-15 criteria to the Interim Finance Committee for approval. Upon approval of
1-16 the policies, procedures and criteria, the Interim Finance Committee shall
1-17 transmit a copy of the policies, procedures and criteria to the Department
1-18 of Education. The policies, procedures and criteria adopted by the State
1-19 Board of Examiners may not be used until they are approved by the Interim
1-20 Finance Committee.
1-21 4. If the administrator of an existing educational program believes that
1-22 the program is at risk of termination because of a lack of funding during
2-1 the 2001-2003 biennium, the administrator of the program may submit a
2-2 request to the Department of Education for an allocation from the
2-3 appropriation in subsection 1.
2-4 5. The Department of Education, the Budget Division of the
2-5 Department of Administration and the Fiscal Analysis Division of the
2-6 Legislative Counsel Bureau shall jointly review a request submitted
2-7 pursuant to subsection 4, using the policies, procedures and criteria
2-8 approved by the Interim Finance Committee pursuant to subsection 3.
2-9 Upon completion of the review, a recommendation for or against an
2-10 allocation to the requesting educational program must be submitted to the
2-11 State Board of Examiners.
2-12 6. The State Board of Examiners shall consider each request and
2-13 recommend the amount of the allocation, if any, to the Interim Finance
2-14 Committee.
2-15 7. The Interim Finance Committee is not required to approve the entire
2-16 amount of an allocation recommended pursuant to subsection 6 or to
2-17 allocate the entire amount appropriated by subsection 1.
2-18 8. Any remaining balance of the sum appropriated by subsection 1
2-19 must not be allocated by the Interim Finance Committee after June 30,
2-20 2003, and reverts to the state general fund as soon as all payments of
2-21 money committed have been made.
2-22 Sec. 2. This act becomes effective on July 1, 2001.
