AN ACT relating to the Nevada National Guard; authorizing the Board of Regents of the University of Nevada to waive the registration fees and other fees for certain members of the Nevada National Guard during the 2003-2005 biennium; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  The Board of Regents of the University of

1-2  Nevada may grant a waiver of registration fees and laboratory fees

1-3  for any member of the active Nevada National Guard, including,

1-4  without limitation, a recruit, who attends a school within the

1-5  University and Community College System of Nevada as a full-time

1-6  or part-time student. For the purpose of assessing fees and charges

1-7  against a person to whom a waiver is granted pursuant to this

1-8  subsection, including, without limitation, tuition charges pursuant to

1-9  NRS 396.540, such a person shall be deemed to be a bona fide

1-10  resident of this state.

1-11      2.  To be eligible for a waiver pursuant to subsection 1, a person

1-12  must:

1-13      (a) Be a member in good standing of the active Nevada National

1-14  Guard, including, without limitation, a recruit, at the beginning of


2-1  and throughout the entire semester for which the waiver is granted;

2-2  and

2-3  (b) Maintain at least a 2.0 grade point average, on a 4.0 grading

2-4  scale, each semester, or the equivalent of a 2.0 grade point average

2-5  if a different grading scale is used.

2-6  3.  The Board of Regents may request the Adjutant General to

2-7  verify the membership in the active Nevada National Guard of a

2-8  person who is seeking or has been granted a waiver of registration

2-9  fees and laboratory fees pursuant to subsection 1. The Adjutant

2-10  General shall, upon receiving such a request, notify the Board of

2-11  Regents in writing concerning the status and dates of membership of

2-12  that person in the active Nevada National Guard.

2-13      4.  If a waiver is granted pursuant to subsection 1 for a recruit

2-14  and the recruit does not enter full-time National Guard duty within 1

2-15  year after enlisting, the recruit shall reimburse the Board of Regents

2-16  for all registration fees and laboratory fees waived on behalf of the

2-17  recruit if his failure to enter full-time National Guard duty is

2-18  attributable to his own conduct.

2-19      5.  As used in this section:

2-20      (a) “Full-time National Guard duty” has the meaning ascribed to

2-21  it in 32 U.S.C. § 101(19).

2-22      (b) “Recruit” means a person who has enlisted in the Nevada

2-23  National Guard but has not begun his required military duty.

2-24      Sec. 2.  This act becomes effective upon passage and approval

2-25  and applies retroactively from and after July 1, 2003, and expires by

2-26  limitation on June 30, 2005.
