ASSEMBLY RESOLUTION—Acknowledging that the Nevada Legislature has the constitutional duty to provide for the support and maintenance of the schools in this state and determining the appropriate amount of the appropriations for their support and maintenance.
1-1 Whereas, The Supreme Court of the United States has stated
1-2 that education “fulfills a most fundamental obligation of
1-3 government to its constituency” and is “perhaps the most important
1-4 function of state and local governments”; and
1-5 Whereas, Ensuring the effectiveness of the schools in this state
1-6 is vital to the success of Nevada’s children, Nevada’s residents and
1-7 the economy of this state; and
1-8 Whereas, Sections 2 and 6 of Article 11 of the Nevada
1-9 Constitution require the Nevada Legislature to provide for a uniform
1-10 system of common schools and to provide for their support and
1-11 maintenance, in addition to other means provided, by legislative
1-12 appropriation from the State General Fund; and
1-13 Whereas, Section 19 of Article 4 of the Nevada Constitution
1-14 prohibits the expenditure of money from the State Treasury without
1-15 a legislative appropriation, and legal authority in this state requires
1-16 that money appropriated by the Nevada Legislature for one purpose
1-17 may not be used for any other purpose; and
1-18 Whereas, The Nevada Legislature therefore has a
1-19 constitutional duty to appropriate money to provide for the support
2-1 and maintenance of the schools in this state for the next two fiscal
2-2 years; and
2-3 Whereas, Both houses of the Nevada Legislature have found
2-4 that the amount of the proposed appropriations from the State
2-5 General Fund to the State Distributive School Account and for
2-6 class-size reduction as set forth in the second reprint of Senate Bill
2-7 No. 6 of the 20th Special Session of the Nevada Legislature is the
2-8 appropriate amount for the support and maintenance of the schools
2-9 in this state and for class-size reduction; and
2-10 Whereas, Both houses of the Nevada Legislature have found
2-11 that the policies on education as set forth in the second reprint of
2-12 Senate Bill No. 6 of the 20th Special Session of the Nevada
2-13 Legislature are the policies on education of the Nevada Legislature;
2-15 Resolved by the Assembly of the State of Nevada, That
2-16 the Assembly hereby acknowledges its constitutional duty to
2-17 provide for the support and maintenance of the schools in this state;
2-18 and be it further
2-19 Resolved, That the Assembly hereby determines that the
2-20 amount of the proposed appropriations from the State General Fund
2-21 to the State Distributive School Account and for class-size reduction
2-22 as set forth in the second reprint of Senate Bill No. 6 of the 20th
2-23 Special Session of the Nevada Legislature is the appropriate amount
2-24 for the support and maintenance of the schools in this state and for
2-25 class-size reduction; and be it further
2-26 Resolved, That the Assembly finds that the policies on
2-27 education as set forth in the second reprint of Senate Bill No. 6 of
2-28 the 20th Special Session of the Nevada Legislature are the policies
2-29 on education of the Nevada Legislature; and be it further
2-30 Resolved, That the Chief Clerk of the Assembly prepare and
2-31 transmit a copy of this resolution to the Supreme Court of Nevada
2-32 for consideration in any litigation related to the issues concerning
2-33 the duty of the Nevada Legislature to provide for the support and
2-34 maintenance of the schools in this state.
