AN ACT making conditional appropriations to the National Judicial College and the Louis W. McHardy National College of Juvenile and Family Justice; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  Notwithstanding the provisions of

1-2  NRS 353.235:

1-3  (a) Upon receipt of the projections and estimates of the

1-4  Economic Forum required by paragraph (d) of subsection 1 of NRS

1-5  353.228 to be reported on or before December 1, 2004, the Interim

1-6  Finance Committee shall project:

1-7       (1) The ending balance of the State General Fund for Fiscal

1-8  Year 2004-2005, using all relevant information known to it; and

1-9       (2) The amount, if any, by which the projection required by

1-10  subparagraph (1) exceeds the sum of:

1-11             (I) The amount of the ending balance of the State General

1-12  Fund for Fiscal Year 2004-2005 as estimated by the Nevada

1-13  Legislature; and

1-14             (II) The amount of money necessary to fulfill any

1-15  contingent appropriation required by the Nevada Legislature to the


2-1  Fund to Stabilize the Operation of the State Government created by

2-2  NRS 353.288.

2-3  (b) If the amount projected by the Interim Finance Committee

2-4  pursuant to subparagraph (2) of paragraph (a) is $350,000 or more,

2-5  there is hereby contingently appropriated from the State General

2-6  Fund to:

2-7       (1) The National Judicial College the sum of $225,000 to

2-8  assist in securing public and private grants and other funding for

2-9  support; and

2-10          (2) The Louis W. McHardy National College of Juvenile and

2-11  Family Justice the sum of $125,000 to assist in securing public and

2-12  private grants and other funding for support.

2-13      (c) If the amount projected by the Interim Finance Committee

2-14  pursuant to subparagraph (2) of paragraph (a) is more than $0 but

2-15  less than $350,000, there is hereby contingently appropriated from

2-16  the State General Fund to the National Judicial College and the

2-17  Louis W. McHardy National College of Juvenile and Family Justice

2-18  the sum projected by the Interim Finance Committee pursuant to

2-19  subparagraph (2) of paragraph (a), divided between the National

2-20  Judicial College and the Louis W. McHardy National College of

2-21  Juvenile and Family Justice in a manner proportional to the amounts

2-22  of the contingent appropriations set forth in paragraph (b). The sums

2-23  appropriated pursuant to this paragraph are for the purposes set forth

2-24  in paragraph (b).

2-25      2.  Any remaining balance of any contingent appropriation

2-26  made pursuant to this section must not be committed for expenditure

2-27  after June 30, 2005, and reverts to the State General Fund as soon as

2-28  all payments of money committed have been made.

2-29      Sec. 2.  This act becomes effective on July 1, 2004.
