The Assembly Committee on Commerce was called to order by Chairman Gene T. Porter at 3:30 p.m., Wednesday, June 2, 1993, in Room 332 of the Legislative Building, Carson City, Nevada. Exhibit A is the Meeting Agenda, Exhibit B is the Attendance Roster.

SB 201 Prohibits factoring of drafts on credit cards and authorizes banks to report employees' defalcations to each other.

SB 246 REVISES CERTAIN PROVISIONS RELATING TO PRACTICE OF PHARMACY AND STATE BOARD OF PHARMACY.
ASSEMBLYMAN SCHERER MOVED AMEND AND DO PASS BY DELETING LINE 27, SECTION 9, PAGE 4, AND INSERTING: "FEWER THAN 100 BEDS OR IN A CORRECTIONAL INSTITUTION HOUSING FEWER THAN 1,500"; AND TO AMEND LINE 31, SECTION 14, PAGE 6, BY DELETING "ESTABLISHED" AND INSERTING "APPROVED".

SB 254 Allows exchange of information between pharmacists relating to suspected misuse of drugs.

SB 407 Makes various changes relating to licensing and regulation of escrow agencies and agents.

AB 161 Prohibits, under certain circumstances, disclosure of information obtained pursuant to investigation of complaint alleging violation of provisions governing mobile home parks.

MOTION CARRIED UNANIMOUSLY.
AB 187 Limits increase in rent for mobile home lots in certain counties.
Chairman Porter presented the committee members with amendment to AB 187 (See Exhibit C). As Mr. Porter explained, the amendment would remove the fiscal note from the bill.

MOTION CARRIED WITH ASSEMBLYMEN BONAVENTURA, KENNY, AND SCHERER VOTING NO.
AB 234 Revises penalty for first violation and increases penalty for second or subsequent violation of laws governing architects.
AB 311 Makes various changes relating to architecture.
Mr. Scherer requested action not be taken on AB 234 or AB 311. He explained he was meeting with the Board of Architecture to finalize amendments and would present amendments at a later meeting of the committee. Chairman Porter requested a final report be ready for the June 4 meeting.
AB 262 Makes various changes to provisions governing sale and dispensing of hypodermic devices and prophylactic products.
Mr. Heller presented the committee with an amendment to AB 262 (See Exhibit D).

ASSEMBLYMAN PERKINS SECONDED THE MOTION.
MOTION CARRIED UNANIMOUSLY.
AB 334 Prohibits harassment of tenant of mobile home park by landlord.
ASSEMBLYMAN GIUNCHIGLIANI MOVED AMEND AND DO PASS BY CHANGING EFFECTIVE DATE OF BILL TO "UPON PASSAGE AND APPROVAL".
ASSEMBLYMAN KENNY SECONDED THE MOTION.
MOTION CARRIED UNANIMOUSLY.
AB 474 Requires registration of employee leasing companies.
Chairman Porter presented the committee with requested amendments from the Insurance Commissioner (See Exhibit E).
ASSEMBLYMAN WILLIAMS MOVED AMEND AND DO PASS.
ASSEMBLYMAN PERKINS SECONDED THE MOTION.
MOTION CARRIED UNANIMOUSLY.
AB 558 Regulates businesses for repair of motor vehicles.
Mr. Perkins advised he would be holding a subcommittee meeting on AB 558 on Friday, June 4, and would report back to the full committee at a later date.
AB 570 Makes various changes relating to physical therapy.
Ms. Kenny questioned the qualifications of physical therapist assistants. Mr. Bennett answered the assistants must complete a two year educational course, plus one year clinical experience with a licensed physical therapist prior to performing in-home services to patients. Ms. Kenny was concerned over the lack of supervision of assistants, and Assemblyman Giunchigliani concurred with her concerns.
Chairman Porter provided technical amendments to AB 570, and called for a motion.

ASSEMBLYMAN ARBERRY SECONDED THE MOTION.
MOTION FAILED UPON ROLL CALL VOTE. ASSEMBLYMEN ARBERRY, GARNER, HELLER, HUMKE, SCHERER AND PORTER VOTED YES. ASSEMBLYMEN AUGUSTINE, BONAVENTURA, GIUNCHIGLIANI, KENNY, PERKINS, AND WILLIAMS VOTED NO. ASSEMBLYMAN BENNETT ABSTAINED.
AB 358 Regulates reporting of consumer credit.
Mary Santina, representing Retail Association of Nevada, presented the committee members with proposed amendments to AB 358 (See Exhibit F). Ms. Santina reviewed the changes with the committee.

ASSEMBLYMAN SCHERER SECONDED THE MOTION.
MOTION CARRIED UNANIMOUSLY.
Chairman Porter called for motion to introduce Bill Draft Request 54-1796.
BDR 54-1796 Making various changes relating to contractors.
ASSEMBLYMAN GIUNCHIGLIANI MOVED FOR COMMITTEE INTRODUCTION OF BDR 54-1796.
ASSEMBLYMAN WILLIAMS SECONDED THE MOTION.
MOTION CARRIED UNANIMOUSLY.
Chairman Porter requested a motion to permanently waive Rule 92 for the duration of the 1993 Legislative Session.
ASSEMBLYMAN PERKINS MOVED TO WAIVE RULE 92 FOR THE REMAINDER OF THE 1993 LEGISLATIVE SESSION FOR THE ASSEMBLY COMMERCE COMMITTEE.
ASSEMBLYMAN KENNY SECONDED THE MOTION.
MOTION CARRIED UNANIMOUSLY.
There being no further business to come before the committee, Chairman Porter adjourned the hearing at 4:35 p.m.
