The Assembly Committee on Education was called to order by Chairman Wendell P. Williams, at 3:34 p.m., on Monday, April 26, 1993, in Room 330 of the Legislative Building, Carson City, Nevada. Exhibit A is the Meeting Agenda. Exhibit B is the Attendance Roster.

ASSEMBLY BILL 454 - Revises provision governing credit for school teacher's previous service in determining salary of teacher.
Debbie Cahill, Nevada State Education Association, presented testimony in support of the bill and she explained the original bill had been passed during the 1991 legislative session.
Mrs. Cahill referred to two separate salary schedules for teachers which related to individual placement (Exhibit C). Prior to the bill from the 1991 session, most districts had capped incoming teachers at five years regardless of where they had been employed. Mrs. Cahill pointed out current legislation provided teachers the same service credit if they chose to transfer to another district in the state. During the interim, Mrs. Cahill indicated the language of the 1991 bill had created some problems regarding interpretation.
Mike Dyer, legal counsel for the Nevada State Education Association, explained AB 454 amended NRS 391.160, subsection 2 which was a new section added during the 1991 session. The intent of the subsection was to grant a transferring teacher the same standing on the salary schedule as they held at the district they were transferring from but not at the same salary.
Mr. Dyer clarified the 1991 bill had presented no problems for teachers who had only taught in Nevada; however, teachers from out-of-state were normally only credited with five years which amounted to a significant decrease in income. The bill was not designed to require a district to pay any particular amount, nor did it require a district to continue a teacher's salary level at his previous salary level. Mr. Dyer pointed out the vast majority of individuals the bill would apply to were teachers who taught in some of the rural counties for a number of years. Mr. Dyer concluded AB 454 was basically a housekeeping bill to clarify the intent of the bill from the 1991 legislative session.
Ms. Tiffany questioned if any portion of the bill pertained to a teacher's past performance. Mr. Dyer responded the hiring provisions were addressed in a separate Nevada Revised Statute and all school districts had full access to a prospective teacher's personnel records.
Ms. Tiffany asked if the training requirements were in the licensing process. Mr. Dyer replied the licensing provisions along with mandatory continuing education were included in Chapter 391 and were applied across the board.
Mr. Dyer emphasized AB 454 did not require any placement level for any teacher coming from out-of-state; it only applied to teachers who were presently employed in Nevada districts.
