The Assembly Committee on Government Affairs was called to order by Chairman Val Z. Garner at 9:47 a.m., Monday, February 15, 1993, in Room 101/102 of the Cashman Field Center, Las Vegas, Nevada. Exhibit A is the Meeting Agenda. Exhibit B is the Attendance Roster.

ASSEMBLY BILL 133 - Authorizes annexation of portion of unincorporated town by city under certain circumstances if annexation is approved by governing body of unincorporated town.
Ronn Reiss, property owner, explained the bill was introduced primarily to resolve problems of properties located in county islands (surrounded by a city or separated from county by natural barrier, i.e. a major wash). Exhibit C shows property that is a "county island," thus causing difficulties accessing utilities and emergency services. This bill gives property owners an opportunity to go to county commissioners and request permission to present property to city to ask for annexation.
Mrs. Segerblom inquired as to the development in the area indicated on the map.
Mr. Reiss pointed out on the aerial map the development activity surrounding the highlighted area.
Mr. McGaughey questioned the availability of emergency services to the area. Mr. Reiss referred to page 6 of Exhibit C under Public Safety.
Discussion between Mrs. Lambert and Mr. Reiss ensued regarding the unincorporation of the township.
Mr. McGaughey asked the distance from Mr. Reiss' property to county territory. Mr. Reiss responded it is 1/2 mile, however, in order to attach to sewer approximately 3/4 mile, for water over 1 mile, and fire department about 3 miles. Mr. Reiss and Mr. McGaughey agreed one fire department would resolve the emergency services problem.
Mr. Kurt Fritsch, City of Henderson, appeared to announce support of AB 133. The City of Henderson does not collect taxes or provide water to these islands. This annexation would benefit Henderson.
Mr. McGaughey asked if it would be possible for people to pay a fee to the City of Henderson for water and sewage services.
Mr. Fritsch responded they could, however, it has been the city policy not to extend water because it is a precious commodity. Sewer services are extended to industrial services.
Mr. Garner inquired if the City of Henderson was in agreement with the wording of the bill.
Mr. Fritsch explained the only thing questioned was on page 1, line 19 if both the township board and the Clark County Commissioners were included.
Mr. Garner indicated the legal department would be contacted for clarification.
Mr. Reiss suggested the bill should not say Clark County. It should refer to the governing body, be it county commission, city council, etc.
Mr. Neighbors questioned if Mr. Reiss was referring to town boards or unincorporated towns. Mr. Reiss responded unincorporated town advisory boards.
Mr. Neighbors inquired about the people in the area, what would be the recourse of the people not desiring the annexation? Mr. Reiss pointed out the county commission in Clark County requests the person go to the advisory board in the unincorporated township in order to obtain recommendation before asking for a decision. It does not apply to someone else's property, only the person requesting annexation.
Mrs. Segerblom indicated this property is in her district and she wanted to know the property zoning. Mr. Reiss responded it is zoned residential and commercial; however, Henderson would have the final say.
The hearing was closed on AB 133.
Mr. Garner established a procedure for all future amendments requested with respect to bills. As amendments were assigned to members or to a subcommittee, members should work through Dana Bennett, Senior Research Analyst. Amendment drafts should be returned to committee with recommendations. The committee would then vote on amendments and return them to Mrs. Bennett who would then take them to the legal division to have amendments drafted.
There being no further business to come before committee, the meeting was adjourned at 10:10 a.m.
