The Assembly Committee on Government Affairs was called to order by Chairman Val Z. Garner at 8:03 a.m., Tuesday, March 16, 1993, in Room 330 of the Legislative Building, Carson City, Nevada. Exhibit A is the Meeting Agenda. Exhibit B is the Attendance Roster.

BILL DRAFT REQUEST 22-690 - Provides date for valuing land purchased by school district within subdivision.

BILL DRAFT REQUEST 21-819 - Clarifies that municipality may by condemnation acquire property for project within or without municipality.

BILL DRAFT REQUEST 22-1436 - Authorizes unincorporated towns to impose impact fees.

ASSEMBLY BILL NO. 198 -Revises Procedure for refunding surplus money from local improvement districts.
Maureen D'Ambra, Special Improvement District Coordinator, Clark County Department of Public Works, explained she was the author of the proposed legislation. She then delivered Exhibit C which explained the purpose of AB 198. In conclusion, she referenced the hardship ordinance adopted during the last legislative session, adding AB 198 would offset costs if a property owner could not make payment.

ASSEMBLYMAN MCGAUGHEY SECONDED THE MOTION.
THE MOTION CARRIED.
ASSEMBLY BILL NO. 256 -Provides that home addresses of certain public officers, public employees and their families may be made confidential.
Chairman Garner asked the audience if there was anyone present to speak in favor of AB 256. No one came forward.
The hearing on AB 256 was closed with no action taken.
ASSEMBLY BILL NO. 257 -Clarifies authority of board of regents to contract with different types of investment entities in providing retirement program for professional staff.
Mark Dawson, Chancellor, University and Community College System of Nevada, spoke in support of AB 257 utilizing Exhibit D.
Mark Feldman, President, Mark Feldman Associates, stated he was an attorney and consultant to the insurance industry, appearing by request of the University on behalf of Variable Annuity Life Insurance Company. Exhibit E was Mr. Feldman's prepared statement to the committee.
Mr. Garner stated most people working in the university system did not participate in the Public Employees Retirement System. Mr. Dawson replied only new-hired professional employees could not participate in the state retirement program, but all classified employees did. Mr. Garner then clarified AB 257 was another option to expand the flexibility for investment and to enhance a person's retirement portfolio.
Mrs. Lambert referenced Page 1, lines 21 through 24, and asked if mutual funds, banks, etc., would remain viable options. The answer was not right now, but they could in the future.
Mrs. Segerblom questioned if the funds could be used if a person transferred from Nevada to California. The reply was yes. She then asked how reliable the fund was, mentioning what had occurred with Executive Life. Mr. Dawson answered, "They are a lot more reliable, hopefully, than Executive Life." He added, "The companies are huge. TIAA/CREF may be the largest retirement fund in the world. However, if there is a crash as there was in the thirties, it will be affected just like everything else."

THE MOTION CARRIED UNANIMOUSLY.
Chairman Garner asked Dana Bennett to refresh his memory on
AB 253 and told the committee to be prepared to take action on it on Wednesday, March 17, 1993.
There being no further business to come before committee, the meeting was adjourned at 8:25 a.m.
