The Assembly Committee on Health and Human Services was called to order by Chairman Jan Evans at 1:35 p.m., May 27, 1993, in Room 330 of the Legislative Building, Carson City, Nevada. Exhibit A is the Meeting Agenda, Exhibit B is the Attendance Roster.

WORK SESSION
SENATE BILL 60: Expands requirement for testing persons arrested for certain sexual offenses for exposure to sexually transmitted diseases.
Ms. de Braga noted there were two subcommittee meetings on SB 60; the second meeting held primarily to make sure everyone was in accordance with the amendments. Changes in the proposed amendment are shown in Exhibit C. Ms. de Braga commended Mary Lynn Evans and David Rowles for the majority of the work.
Mary Lynn Evans, Administrator/Office of Narcotics Control Assistance, indicated there was no cost to the state; however, the counties could incur some fiscal note. She noted by making the perpetrator liable for all related costs (as seen in Section 3), this should lighten the load for the counties and have costs come back to them.
Mr. Toomin stated in view of the fact there was not going to be a fiscal impact to the state, the fiscal statements involving effect on local government vs. the state should be reversed. Chairman Evans agreed, saying it would draw attention when people were reviewing the bill.
MRS. FREEMAN MOVED AMEND AND DO PASS ON SB 60.
MS. DE BRAGA SECONDED THE MOTION.

ASSEMBLY BILL 168: Makes various changes relating to preliminary medical examination of allegedly mentally ill person before transportation to mental health facility.
Mrs. Freeman reviewed the amendment to AB 168 (Exhibit D) and indicated the bill would remove restriction on location at which certain medical examinations of allegedly mentally ill persons would be performed.
Responding to Ms. Augustine's question regarding the bill, Mrs. Freeman said trying to follow the amendment would cause confusion. She indicated the bracket was to remain on lines 12 and 14, all italicized language should come out, and brackets on lines 21 and 22 were to be removed.
MRS. FREEMAN MOVED AMEND AND DO PASS ON AB 168.
MR. GIBBONS SECONDED THE MOTION.

SENATE CONCURRENT RESOLUTION NO. 17: Supports personal assistance service for persons with disabilities.
Mrs. Evans asked research analyst Kerry Davis to explain the changes (Exhibit E) in the proposed amendments to SCR 17.
Since the purpose of the bill was for persons with disabilities, Mrs. Evans suggested listing them first in paragraph three, followed by administrators of personal assistance programs, agency representatives, state legislators and other interested parties.
MR. TOOMIN MOVED AMEND AND ADOPT SCR 17.
MR. PETRAK SECONDED THE MOTION.
THE MOTION CARRIED UNANIMOUSLY WITH ASSEMBLYMAN SMITH BEING ABSENT AT THE TIME OF THE VOTE.
Mrs. Evans thanked Mr. Petrak, Mrs. Segerblom and Ms. Davis for their work on the amendment.

ASSEMBLY BILL 444: Creates presumption of knowing use of controlled substance under certain circumstances.
Mr. Williams indicated he had talked to members of the subcommittee and their legal expert maintained nothing could be done to compromise or change AB 444. He noted the subcommittee recommendation was to Indefinitely Postpone the bill.
Mrs. Evans stated a time should be scheduled for Assemblyman Spitler and Captain Oakes to come in for a final discussion on the measure.

ASSEMBLY BILL 556: Authorizes formation of multidisciplinary teams to investigate deaths of children.
Mrs. Evans noted AB 556 was Mr. Scherer's bill and asked for a status report.
Mr. Toomin explained there was some concern with Clark County regarding the inclusion of all children under the age of 18 for those reports to be investigated because of the amount of money it would cost. He noted he had asked Mr. Scherer if the following could be included in the bill: "If a parent or relative of a victim could at least request an investigation of that team." Mr. Scherer indicated he would take that back down to Clark County for approval.
Mrs. Evans asked Mr. Toomin to contact Mr. Scherer one more time to ask for a time certain.

ASSEMBLY BILL 602: Makes various changes regarding payment of fees for treatment of indigent clients in state mental health facilities.
Mrs. Evans requested a status report from Mr. Toomin.
Mr. Toomin indicated he had been besieged by telefaxes by the smaller counties relative to their concern of defining "dental emergencies." He added the primary concern of the counties was money, as they did not want to be financially responsible.
Mrs. Evans urged Mr. Toomin to seek a time certain.

SENATE BILL 184: Permits physician to authorize registered nurse to make pronouncement of death under certain circumstances.
Mr. Toomin voiced concern relative to Section 2, subsection 7, (a) (3) as to the removal of the word "hospital."
Mrs. Evans appointed Mr. Gibbons to confer with Senator Rawson as to unanswered questions facing the committee.

ASSEMBLY BILL 211: Revises certain provisions relating to persons authorized to possess and administer controlled substances and dangerous drugs.
Mrs. Freeman indicated an amendment was being drafted and should be out soon.
There being no further business to come before committee, the meeting was adjourned at 2:10 p.m.
