      ASSEMBLY COMMITTEE ON TRANSPORTATION

 

      Sixty-seventh Session

      April 21, 1993

 

 

 

The Assembly Committee on Transportation was called to order by Chairman Larry L. Spitler, at 2:15 p.m., on Wednesday, April 21, 1993, in Room 331 of the Legislative Building, Carson City, Nevada.  Exhibit A is the Meeting Agenda.  Exhibit B is the Attendance Roster.

      WORK SESSION

 

SENATE CONCURRENT RESOLUTION NO. 6:  Directs Department of Transport                                       ation to conduct study of certain

                                     methods of making area surround                                       ing certain public libraries                                         safer for pedestrians.  

 

Chairman Spitler stated the fiscal note requested at the prior hearing  on S.C.R. 6 was determined (by the Director of Transportation) to be approximately $10,000.  Chairman Spitler relayed; however, he became aware that resolutions did not necessarily require fiscal notes.  Answering a question from Mr. Collins, Mr. Spitler stated the Department of Transportation would provide funding for the cost of library studies requested by the proposed bill.

 

Mrs. Chowning reiterated her position that libraries were fast becoming heavily marketed areas which provided many activities for children and families.  She felt by approving the bill, the committee would have enacted an excellent, responsible measure.

 

Chairman Spitler agreed with Mrs. Chowning's comments and stated the Department of Transportation was not able to randomly place traffic safety devices as they had a number of guidelines to follow.

 

      MR. ANDERSON MOVED TO ADOPT S.C.R. 6.

 

      MR. TOOMIN SECONDED THE MOTION.

 

      MOTION CARRIED UNANIMOUSLY BY THOSE PRESENT.

 

Chairman Spitler requested Mrs. Chowning handle the bill on the floor.

 

 

ASSEMBLY BILL NO. 336:  Exempts driver of taxicab from requirement of                         wearing safety belt while he is on duty.

 

      MR. GARNER MOVED TO INDEFINITELY POSTPONE A.B. 336.

 

      MR. HETTRICK SECONDED THE MOTION.

 

      MOTION CARRIED UNANIMOUSLY BY THOSE PRESENT.

 

ASSEMBLY BILL NO. 200:  Requires division of department of motor                             vehicles and public safety to exchange                               information from applications for driver's                           icenses to identify persons who may have                             unlawfully failed to register motor vehicles                          in this state.

 

Copies of the proposed amendment to A.B. 200 were distributed (Exhibit C). Chairman Spitler stated the amendment did incorporate concerns addressed by committee members at the last work session.

 

      MR. GARNER MOVED TO AMEND, DO PASS AND RE-REFER A.B. 200.

 

      MR. TOOMIN SECONDED THE MOTION.

 

      MOTION CARRIED UNANIMOUSLY BY THOSE PRESENT.

 

ASSEMBLY BILL NO. 176:  Requires governing body of political                                 subdivision and attorney general, under                              certain circumstances, to bring action to                            allow access to public road. 

 

Chairman Spitler stated the intent of placing A.B. 176 on the agenda was for Mrs. Chowning, A.B. 176 subcommittee chairman, to give an update.  Another opportunity for public testimony on proposed amendments would be held at another subcommittee meeting.  He stated the subcommittee's recommendation would be brought back before the full Transportation Committee for one last opportunity for public comment before being voted upon in the Assembly.

 

Mrs. Chowning expressed gratitude to Bob Erickson, Research Director, and committee members for their assistance on the subcommittee.  She then presented the subcommittee's final draft of proposed amendments (Exhibit D) to A.B. 176.  Mrs. Chowning stated the next scheduled subcommittee meeting was Thursday, April 29, 1993 at 1:15 p.m.

 

Mr. Anderson commended the work of the subcommittee which provided many opportunities for public input.

 

Answering a question from Mr. Garner regarding the amount of testimony heard in opposition to the bill, Mrs. Chowning stated opposition had subsided with allowed input needed in formulating the amendment.  She felt the next subcommittee meeting would see very little opposition as the private property owner's concerns were met and counties were not mandated conclusive cost measures.

 

Mr. Hettrick commented the public road problem was addressed, and although not everyone was thrilled with every aspect of the bill, the subcommittee had allowed in every possible way to satisfy concerns heard. He felt the bill was a step in the right direction.

 

Mr. Anderson reiterated the subcommittee provided a clear opportunity for both sides of the issue to focus on the road issue and the bill was given more than an adequate amount of opportunity for input.         

Mrs. Chowning repeated the committee's fortune of having Bob Erickson's assistance as he was also on staff in 1979 when a Senate Interim Committee worked on the public road access problem.

 

With no further business, meeting was adjourned at 2:35 p.m.
