The Senate Committee on Commerce and Labor was called to order by Chairman Randolph J. Townsend, at 8:30 a.m., on April 6, 1993, in Room 227 of the Legislative Building, Carson City, Nevada.  Exhibit A is the Meeting Agenda.  Exhibit B is the Attendance Roster.

Senator Townsend opened the hearing on Bill Draft Request (BDR) 54-1010.

BDR 54-1010:      Regulates the practice of dietitians.

Senator Townsend opened discussion on SENATE BILL (S.B.) 199.

 

SENATE BILL 199:  Makes various changes to protect ownership or other interests upon sale of mobile homes and similar vehicles.

 

Joan Clements, Administrator, Manufactured Housing, State of Nevada presented a statement contained in Exhibit C.  Ms. Clements gave a detailed explanation of this statement.  Charles W. Joerg, Lobbyist, Nevada Manufactured Housing Association, testified his organization totally supported this new statute.  There was a short discussion on Senator O'Connell's question regarding taxes on manufactured homes.  Ms. Clements stated The Mobile Home Owners League of the Silver State, Inc., also supports this bill.

 

Senator O'Connell asked a question regarding the financing and sale practices in S.B. 199.  After a discussion between Ms. Clements and Mr. Joerg, it was noted by Senator Townsend the subject under discussion was about personal property, not real property that would be secured by a mortgage.

 

Senator Townsend closed the hearing on S.B. 199 and opened the hearing on S.B. 209. 

 

SENATE BILL 209   Adopts more recent edition of certain uniform codes for manufactured buildings and authorizes most recent edition of uniform codes to be adopted by regulation.

 

Ms. Clements offered Exhibit D an explanation of this bill.  Senator Brown wanted to know if those companies who produced the manufactured homes were updated on new approvals as far as building codes were concerned.  Ms. Clements assured her they were. 

 

Mr. Joerg stated that the Nevada Manufactured Housing Association supported S.B. 209.  Ms. Clements said the Mobile Homeowners League of the Silver State supported this bill as well.

 

Senator Townsend wanted to know if there were federal regulations and standards.  Ms. Clements affirmed there was, indeed, a Federal Manufactured Housing Commission.  Senator Lowden wanted to know how the regulations might affect older mobile homes and was told by Ms. Clements the commission was not allowed to back track the law, but of course, new units must adhere to new rules and regulations.

 

During a discussion between Senator Brown, Ms. Clements and Mr. Joerg, it was noted there are zoning problems as far as finding places for mobile homes to be put when a mobile park closes.  Mr. Joerg brought out the fact a bill was to be introduced in the assembly regarding zoning of manufactured housing.  

 

Chairman Townsend closed the  hearing on S.B. 209 and opened the hearing on S.B. 330.

 

SENATE BILL 330:  Revises qualifications of certain members of board for regulation of liquefied petroleum gas.

 

Senator Nevin  stated he had introduced this bill, but planned to defer to members of the Nevada Propane Dealers Association for testimony.  Stephanie Tyler, Lobbyist, Nevada Propane Dealers Association introduced Michael D. Eriksen, President, Nevada Propane Dealers Association and Gary Nelson, Safety Inspector, Board for the Regulation of Liquified Petroleum Gas.  Mr. Eriksen stated he was at the hearing in support of S.B. 330.  He gave a short history on the Propane Dealers Board.  He noted that because of loose restrictions, oftentimes, people who were not really qualified were made members of the board.  It is hoped this bill will remedy that situation.   

 

Mr. Nelson spoke regarding the excellent safety record in Nevada.  He reiterated this bill would help keep the safety record intact by assuring there were qualified members to guide it.  Mr. Nelson explained he was heavily involved in a training program.

 

Mr. Eriksen  explained to Senator O'Connell, he felt there would probably not be any reorganization of the board.  There was  discussion  between Senator O'Connell, Mr. Eriksen and Mr. Nelson regarding fees paid to the state.

 

Ms. Tyler brought to the attention of the committee the actual change in S.B. 330, lines 11 and 12:

 

      Have a working knowledge of and actual experience in the daily operation of a business classified pursuant to the provisions of subsection 1 of NRS 590.575.

 

Basically, Nevada Revised Statutes (NRS) 590.575 is a list of the five classifications of propane dealers, specifying class 1 as:

 

      A fully licensed dealer who is engaged in the business of installing equipment for the use of LPG (liquid petroleum gas) and who sells, fills, refills, drives and/or is permitted to deliver any LPG.

 

Ms. Tyler stated her organization's concern was technically, the way the law reads at this time, any individual who falls under classification 4 or 5, i.e., gas station attendants, or persons  operating in R.V. parks or convenience stores would be eligible for the board.  She went on to say the organization was asking for clarification of what they understood to be the original legislative intent.

 

Mr. Nelson noted at this time there were no openings on the board and all members fell under a classification of class 1.

 

Chairman Townsend announced the new subcommittee for mobile homes,  Senator Brown to be the new chairman.

Chairman Townsend announced that S.B. 199 and S.B. 209 would be handled by Senator Brown on the floor.  Senator Nevin will handle S.B. 330.

 

Senator Townsend noted Governor Miller is presenting S.B. 316 at 3:30 p.m. this afternoon in Room 119.

 

There being no further business, the meeting was adjourned at
