The Senate Committee on Commerce and Labor was called to order by Chairman Randolph J. Townsend, at 8:00 a.m., on Monday, April 19, 1993, in Room 227 of the Legislative Building, Carson City, Nevada. Exhibit A is the Meeting Agenda. Exhibit B is the Attendance Roster.

Chairman Townsend opened the hearing on Senate Bill (S.B.) 357.
S.B. 357: Expands definition of "medical laboratory."
Fred Hillerby, Lobbyist, Associated Pathologists Laboratories, gave a brief overview of why his organization supported the bill. He submitted a letter from Governor Bob Miller to Secretary of State Cheryl Lau (Exhibit C), regarding his veto of S.B. 192 of the Sixty-sixth Session.
S.B. 192 of the
Sixty-sixth Session: Expands definition of "medical laboratory."
The language in S.B. 357 would address the Governor's concerns, as well as those of the bill's requesters.
Jim Nadeau, Lieutenant, Washoe County Sheriff's Office, stated his organization's support of the bill.
Marsha Berkbigler, Lobbyist, Nevada State Medical Association, also expressed support of S.B. 357.
Richard Pinelli, Health Facilities Surveyor, Bureau of Licensure, Medical Laboratory Services, Health Division, Department of Human Resources, State of Nevada, submitted printed testimony which supported the bill (Exhibit D).
Senator Lowden asked about the difference between a law enforcement officer's test and a business' test.
Mr. Pinelli said in laboratory settings other than the forensic laboratory, the results were used for determining health status, and public health. A forensic laboratory's results were used for court cases, and law enforcement.
Mr. Hillerby explained the forensic laboratories were already subjected to such stringent checks and balances it was not necessary for them to be included.
SENATOR NEVIN MOVED TO DO PASS S.B. 357.
SENATOR SHAFFER SECONDED THE MOTION.

Senator Townsend closed the hearing on S.B. 357, and opened the hearing on Assembly Bill (A.B.) 237.
A.B. 237: Makes various changes to provisions governing practice of chiropractic.
Bill Bailey, Doctor of Chiropractic, Secretary, Nevada State Board of Chiropractic Examiners, submitted an explanation of the bill (Exhibit E), and of the proposed fees (Exhibit F).
Senator Townsend asked what would be done with additional revenue if the fees were raised. Dr. Bailey said they would hire a part-time investigator, build up their reserve fund, and have additional money to pay the increased assessments from the state's reorganization.
Stephanie Tyler, ex-Senator, Lobbyist, Nevada State Chiropractic Association (NSCA), supported the bill, and further explained the intent.
Lou Harter, Doctor of Chiropractic, submitted suggested amendments to A.B. 237 (Exhibit G). He stated he was offended by the language in the proposed legislation.
Senator O'Connell asked if the doctor had discussed his concerns with the NSCA. Dr. Harter stated he had not.
Senator Townsend said Dr. Harter brought up some good points, and asked Senator Shaffer to deal with the issues in subcommittee.
As there was no further business, the meeting was adjourned.
