The joint meeting of the Senate Committee on Finance and the Assembly Committee on Ways and Means was called to order by Chairman William J. Dan Miles, Fiscal Analyst, reported the Senate Committee on Finance added funding to replace a dishwasher and paint the mansion.  It was pointed out allocation for painting the mansion was also included in the Capital Improvements Program.

Mr. Miles testified the closing action on the Base budget indicates both committees restored the computer position.  He stated the Senate Committee on Finance "moved an account clerk position authorized in l995, back to l994."  Additionally, 2 months of vacancy savings have been factored in for the new positions in recognition that it would be difficult for those positions to come on-line on July l, l993.  The enhancements depict 2 months of vacancy savings for the recommended solicitor general position, he pointed out.  "The budget for the new telemarket [unit] proposed and approved for the Office of the Attorney General to pursue telemarketing fraud, in closing the telemarketing section, the difference between actions taken by the Senate Committee on Finance and Assembly Committee on Ways and Means was regarding computer equipment," he elaborated.  The Senate Committee on Finance reduced the amount from $25,000 to $l7,000. 

 

Senator Raggio pointed out the telemarketing task force suggested a report be submitted from both the Consumer Affairs Telemarketing Unit and the Office of the Attorney General relative to the effectiveness of the program.  Senator Raggio suggested a letter of intent be included in the motion to reflect that suggestion.

Mr. Miles testified a portion of the telemarketing closing action taken by the Senate Committee on Finance was to add $45,000 each year for litigation expenses, which was placed in a different account in the Office of the Attorney General.

Mark Stevens, Fiscal Analyst, testified the Assembly Committee on Ways and Means action included $69,429 in each year of the biennium in the Regent Discretionary Fund account.  He explained:

 

      This amount of money has been included in the University System Administration budget for a number of years and the Assembly [Committee on Ways and Means] felt that could be continued to try and offset some of the cost associated with adding the unemployment compensation amounts.

Mr. Stevens explained there was approximately $l7,500 included in legal expenses in the Operating category.  He testified $8,859 represented payments from WICHE to the Office of the Attorney General.  Mr. Stevens reminded the committee, "...l00 percent General Fund agencies, that money is now contained within the attorney general's budget, per the cost allocation plan so that is unnecessary."

WICHE Loan Fund - Page l76

 

Mr. Stevens explained the action taken by the Assembly Committee on Ways and Means was based on a revised budget, submitted by the Budget Division, which extended the appointments for the current physical therapy positions from 2 to 3 years.  He summarized, "There are no WICHE physical therapy positions in the upcoming biennium because UNLV [University of Nevada, Las Vegas] will begin a program in the fall of l993."

 

Senator Raggio queried whether that action accommodated students presently in the program.

 

Mr. Stevens responded in the affirmative.

Self-Insurance Fund - Page l92

 

Mr. Miles drew the committee's attention to the Enhancement category, number 5l0, in the exhibit material and explained an adjustment of $7 million was the action of the Senate Committee on Finance. 

 

SENATE BILL 278:  Allows certain additional retired public employees to participate in group insurance plan.

 

Mr. Miles emphasized that action affects Senate Bill 278, which implements a proposal in the Governor's budget to allow local government, or retirees from the Public Employees Retirement System, to join the state health insurance program.  He explained the Senate Committee on Finance changed the effective date of the bill to January l, l994.  He explained, "This provides the authority to accept and expend the funds from those retirees and these retirees would have to pay those premiums themselves."

 

Senator Raggio pointed out there would be no impact to the General Fund. He explained the eligible individuals would pay the full cost of the premiums.  The bill also provided a separate rating program for those eligible candidates.

 

ASSEMBLY BILL 19:Makes various changes regarding public employees.

 

Mr. Stevens explained closing action taken by the Assembly Committee on Ways and Means was related to Assembly Bill l9, which would provide an increase in retired group insurance benefits to state employees based on years of service.  He stated Risk Management requested $48,500 to make changes to their data processing system which has been included in the closing report.

Public Works Board Inspection Section - Page 287

 

Mr. Miles explained the difference in the closing action taken by the Senate Committee on Finance was due to mothballing the Lovelock prison and creation of two separate budget accounts within the State Public Works Board administration.

 

Mr. Stevens explained the difference in the closing action taken by the Assembly Committee on Ways and Means provided for maintenance positions to extend the warranties until the Lovelock prison facility is occupied.  He explained those costs would be paid from the construction project.  The Assembly Committee on Ways and Means split the State Public Works Board budget into two different budgets:  one would be the administration account, funded through the General Fund, the other would be the inspection account, funded by inspection fees.

 

Senator Raggio asked what was the total savings realized as a result of mothballing the Lovelock prison.

 

Mr. Stevens responded $l.2 million over the biennium.

 

Senator Raggio commented, "The money for that, although it is reflected here, is available from bond proceeds that were allocated for that project?.

 

Mr. Stevens responded in the affirmative.

 

Senator Raggio asked for comments from Judy Matteucci, Director, Department of Administration, regarding the proposal to separate the inspection section from the administrative section.

 

Ms. Matteucci responded:

 

      In discussing the proposed separation of the two accounts with Tom Stephens, the manager, he indicated that would really complicate some of the flexibility he needs due to the crossover of assignments.  So I was unfamiliar with what the reasoning was of the Assembly Committee on Ways and Means as to why they were separated, but that does cause us some problems and we would respectfully request those accounts be kept together.  I don't believe there is a dollar impact by keeping them together.  There is a lot of crossover between people that are General Funded and also doing construction maintenance.  Those people that are construction maintenance, and also doing General Fund, and it really does complicate the accounting if you separate them into two different accounts.

 

Mr. Dini asked Ms. Matteucci to explain the significance of using proceeds from the bonds "which we have done in the first part of it and General Fund money for the second part. I think it would be less complicated to do the split."

 

Ms. Matteucci answered:

 

      The proceeds from the bonds have nothing to do with the combination of the two accounts.  One has previously been funded by General Fund appropriation and it's for general administrative purposes.  But over the course of the biennium, during the budget cuts, a number of previously General Funded positions were transferred into the so called inspection account, which has moved from an inspection account primarily and only to a construction management account.  That construction management fee, as you know, is included in the capital improvement to support those particular positions.  If you combine them in the two accounts, as normally happens during the interim, as we pick up additional projects we will charge a construction management fee and that construction management fee can go to offset additional General Fund.  It would be our hope that eventually this entire account...be cost allocated, except for a very minimal number of people that are necessary to continue a very minimal [State] Public Works Board program.  That's where we were headed with the combination of the two.  During the interim, that has already begun to happen because we had to transfer positions into that construction management account. 

 

      The money for bonding is a result of a need to mothball Lovelock.  We asked bond counsel if it was appropriate.  Normally, the bonding money can be used to mothball a new facility...up to one year after completion of its construction, with no problems.  That's a...standard practice.  However, using...the bond money for the second year will require special language in the capital improvement bill....With that, the bond counsel said that is an appropriate expenditure.  Those expenditures are simply for...the ongoing upkeep of the Lovelock facility prior to the prison taking full occupancy and should not be confused with the combination we proposed of the old [State] Public Works Board account and the new construction management account. 

 

Mr. Dini commented that combining the accounts could have "a plus effect to the General Fund."

 

Ms. Matteucci responded:

 

      It could very well.  As we pick up additional construction projects, they will offset some of the General Fund costs.  Again, we did that during the current biennium, for the [State] Public Works Board, which allowed the [State] Public Works Board to continue operating with a large CIP [Capital Improvement Program] in view of the budget cuts.  That's why we proposed it.  I think it's cost effective and I can assure you they can keep the accounting records appropriate to address Mr. Marvel's concerns.

 

Mr. Arberry interjected:

 

      One of the reasons Mr. Marvel has stated is...why we separated this.  We felt this would have more accountability in having it separated.  So even though, with all due respect to Ms. Matteucci, we would like to have it like this.

Administration - Buildings and Grounds - Page 294

 

Mr. Miles explained the differences in the budget accounts were reflected in the Base budget.  He explained the Senate Committee on Finance deleted the reorganization savings in order to restore the superintendent of buildings and grounds position.  Drawing the committee's attention to the Enhancement category, number 700, he stated the transfer to the capitol police has been reduced because of reductions taken in that budget reflecting group insurance for l2 months, when the expenditure should only have been necessary for 6 months.  "There were compensatory balances budgeted to be paid which is normally not a budget item," he explained. 

 

The Senate Committee on Finance suggested to request a letter of intent to detail the Las Vegas relocation expenses.

Mr. Miles testified the Base budget was adjusted by a transfer to the General Fund, along with the addition of 9.5 positions.  Mr. Miles drew the committee's attention to the transfer to the General Fund and explained the Senate Committee on Finance recommended $5l3,l27 in FY l993-l994 and the Assembly Committee on Ways and Means recommended $52l,284 for the transfer to fund the telemarketing operations in the Office of the Attorney General.  The Senate Committee on Finance reduced that amount, he declared.  The computer equipment was also reduced from $25,000 to $l7,000. 

 

Senator Raggio reminded the committee the decision made by the joint task force was to request a letter of intent stipulating the Office of the Attorney General would give first preference to displaced workers from the Office of Consumer Affairs.  Continuing, he explained authority would be given to the consumer affairs unit to enact regulations essential for its purposes, i.e., the registration function and consumer complaint intake function.  It was also agreed to endorse an interlocal agreement between the agencies for the processing of complaints. 

 

Mr. Arberry reminded the committee the letter of intent would encompass the issue of both agencies to come before the Interim Finance Committee on a quarterly basis to provide status reports.

 

Senator Raggio asked Mrs. Evans whether those recommendations clarified the understanding of the issues requested from the task force committee.

 

Mrs. Evans responded in the affirmative.

Mr. Stevens testified the difference in this budget closing is the addition of a research analyst position.  Testimony was heard before the Assembly Committee on Ways and Means that out-of-state firms needed additional information provided to them when interest was expressed regarding relocating to Nevada.

Mr. Stevens explained the difference in this budget closing was the increase in the amount of $60,000 in advertising revenue, with a corresponding $60,000 for contract location scouting in each year of the biennium.  Additionally, it was suggested a letter of intent be sent to the agency that the additional funding for location scouting not be utilized unless advertising revenue was generated and only to the extent that advertising revenue was generated. 

 

Senator Raggio asked Senator Coffin if that concept agreed with the Senate Committee on Finance.

 

Senator Coffin responded in the affirmative and voiced his agreement with the Assembly Committee on Ways and Means to concur regarding the letter of intent which limits the authorization to the funding from advertising.

Distributive School Account - Page 642

 

Exhibit D, Differences in Distributive School Account, Class-size Reduction Trust Fund and School Improvement Account, was distributed to the committee.

 

Referring to Exhibit D, Senator Rawson summarized the committee actions.  

 

      Item 3:  That was originally set up with one-shot monies and the Governor's office, this time, rolled that into the DSA [Distributive School Account].  It was a decision to keep that out for this biennium and let that roll in the future.  That would protect a couple of the districts that have been hard hit this time to be able to maintain the counselors they had.  I would recommend that we go with the assembly on that issue.

 

      Item 5:  Increase the health insurance to equal the l993 actuals in l994, with a 6 percent increase in l995.  I would recommend the senate go along with the assembly.

 

      Item 6:  We have changed the inflationary increase and adjusted it again since we talked in committee.  It was listed as a 3 percent inflationary increase.  We would recommend that figure be adjusted so this would be an adjustment for both the senate and assembly.  In the first year of the biennium it would be $25l,848, and in the second year it would be $254,862.

 

      Item 7:  The increase, the 50 cent portion of the property tax for revised estimates of assessed valuation, I would recommend the senate go with the assembly.

 

      Item 8:  Be dropped.  Or, in other words, the senate go with the assembly on that.

 

      Item l0:  We would recommend the Eureka County adjustment be dropped this time, that the senate go with the assembly. 

 

      Item ll:  We're together on item number ll. The net effect of that would be an addition of $3.3 million.  It's an estimate....We will have to calculate what the net effect of that will be on the per-pupil guarantee, but it will raise it from $33.l2 to $33.25.

 

Mr. Dini opined it was an excellent compromise to increase funding for K-12 for the upcoming biennium.

 

Senator Raggio declared it was his understanding the compromise was  discussed with "the education lobby and in their analysis, restores overall approximately $l6 million that would be available for their purposes."

 

Mr. Dini responded in the affirmative.

Senator Rawson testified:

 

      The actual figure that has been presented by the State Department of Education is 97l [teachers] that was compared to 988 [teachers]...that was recommended by the budget office.  We had various figures, but if we accept the 97l [teachers] for the first year, then that would give the difference as shown here.  I think if we go with the senate figures on this and the other adjustments that we've made, well, we will have to ask staff.

 

Mr. Stevens testified the action take by the Assembly Committee on Ways and Means included 980.5 teachers.  "The 97l is the latest figure from the Department of Education.  The 980.5 is the number that is currently authorized and the assembly action would retain the number that is currently authorized," he stated.

 

Senator Rawson opined, "It would seem appropriate to go with the actual number to give us the l6:l [ratio]."

 

Mr. Dini interjected:

 

      I think from the testimony we had, the 980.5 [teachers] is the proper figure to use that is in there now.  Otherwise, there will be some deletions to the various school districts. 

 

Senator Coffin asked if the action would allow for enrollment growth in the smaller class sizes and queried, "Do we have a projection, or is this just actual?"

 

Senator Rawson replied:

 

      I think this is a projected number that tells us what the growth will be as of such-and-such a date, I believe, and as any of those projections, it can be up or down.  This is a figure that is adjusted the next year if we were off.  If we were over, the state doesn't owe any money, that would be adjusted out of the next year's appropriation.  If we're under, we would make an adjustment to that before we really started the rest of our budget process.  So there is an attempt to try and keep it fair and even, but that adjustment is made on a 2-year basis.

 

Mr. Dini responded, "There is no General Fund in this, this is the estate tax and I really think it would be appropriate to go with the 980.5. [teachers]"

 

Senator Raggio requested the budget be held.

 

Program Enhancements - Page 650

 

Mr. Stevens explained the closing actions taken by the Assembly Committee on Ways and Means:

      I would propose we send a letter of intent to the department, that they come to the Interim Finance Committee with a plan to see if there are available beds in the community that they could do a better job than they are doing presently at a lower cost.

 

Mr. Marvel asked, "Does the speaker's motion include the possible sale of the land?"

 

Mr. Dini agreed.

 

Senator Raggio clarified:

 

      As I understand what you're saying, it's not a directive, but a letter of intent that they study the feasibility of contracting out the program.  Also, the potential sale of the property and report back to the Interim Finance Committee.  There would be no formal action taken during the interim, other than the report?

 

Mr. Dini responded:

 

      If we had to develop a work program in between sessions, if it was providing a better service to these people, there's only a census of 40 or 42 people; and it's very expensive to maintain the whole plant and all its subsidiary buildings.  It would seem to me like they could develop a plan and then we could transfer the money to a contract....That's the object, I think, of the study...and to provide better service to the clients. 

 

Mrs. Williams cited her recollection:

 

      It's my understanding they did have an opportunity to rent a portion of the existing medical facility if they hadn't had this huge campus that they were responsible for.  I want to be sure I understand this letter when we talk about contracting out.  I don't think...it should mean contracting out those clients to someone.  I thought it was contracting out the entire facility, including those people who currently administer it and provide service.

 

Senator Raggio asked for input from Ms. Matteucci.

 

Senator Rawson stated his understanding to study the feasibility of contracting out the program.

 

Senator Raggio asked if they are suggesting the program may be handled elsewhere than at the institute.

 

Mrs. Williams answered:

 

      When the subcommittee was working on these budgets, we were informed that there had been the possibility of renting out a portion of a medical facility to be used to place Nevada Mental Health Institute as opposed to on the huge campus that currently exists.  On that campus, there are many buildings that aren't being used.  There's only one building being used and it's requiring large sums of money in terms of buildings and grounds and maintenance and they don't need all of that ground.  I know that there have been some inquiries as to the possibility and legality of selling off that great big campus...and realizing some kind of a profit, then being able to rent out a portion of an existing medical facility to house the program.  What we're really talking about is just housing that program, not contracting out the clients.

 

Senator Raggio suggested staff draft a proposed letter of intent, rather than take formal action on the issue.

 

Lake's Crossing - Page 744

 

Mr. Stevens testified the Assembly Committee on Ways and Means closed this budget with an increase in county reimbursement and reduction in the appropriation.  Also, there is an increase of $4,500 the first year of the biennium, and $9,000 the second year, to increase the food budget. 

 

Senator Raggio asked what was the basis for increase in the county reimbursement.

 

Mr. Ghiggeri responded it "is the balancing of the transfer from the Southern Nevada Adult Mental Health Services."

      Youth Community Services Budget, the increase in regular appropriation in the Base budget would be eliminated.  Add the fourth line, medical care, the assembly would match the senate action at $l0,000 in each year of the biennium.  Two new categories would be affected: the non-Title XIX Medical category, which is not listed on the closing sheets, would be reduced by $5,000 in each year of the biennium.  The Emergency Foster Care category, which is also not included on the closing actions, would be reduced by $5,000 in each year of the biennium.  There would be zero General Fund impact.

Mr. Stevens testified in the action taken by the Assembly Committee on Ways and Means, position number 626 was deleted.  This was a position that was included in the internal affairs unit within the Department of Motor Vehicles and Public Safety, he declared.

 

Senator Raggio stated:

 

      The question here is the functioning of the internal affairs unit.  In discussion on the senate side, we felt it was undoubtedly appropriate for some unit of this kind to operate....It wasn't authorized initially and there was no objection to the operation of a unit of this kind, but that it should be limited to the commission personnel.  We need to get a discussion on that before we deal with this budget.

 

Mr. Price stated he chaired the Assembly Subcommittee on Ways and Means dealing with this budget issue.  He explained:

 

      The first initial concern...was the fact that this particular unit had been put together technically illegal...because it was not an authorized budget pulling people out from different areas.  If we're going to have a unit of that function, it should be done legally.  The second concern was...most police departments...have similar functions. 

 

      The word internal affairs, officers are kind of used to.  We felt that it was treating regular civilian employees...at DMV [Department of Motor Vehicles and Public Safety] differently than someone who would be meeting them at Employment Security [Department] or Welfare [Division] and we thought it was improper to have some type of a different system of evaluation and discipline than the rest of the state had. 

 

      I believe Mr. Perkins looked at the regulations that were going to be used....and said they were very good regulations....Our recommendation was that it be disbanded.  But I...would not have any objection to a properly budgeted function for the sworn officers....

 

Mr. Perkins offered the comments:

 

      After having reviewed the regulations that are in place by the Department of Motor Vehicles and Public Safety function, they appear to me to be very strict regulations and very tightly controlled.  I think there may have been some concern the unit was to be used for something other than what it was intended for, and I don't think those regulations allow that. 

 

      I would concur with Mr. Price in that it seemed odd to me to use commission personnel to do disciplinary investigations on noncommissioned personnel, and that may be the big sticking point.

 

Senator Raggio asked if the positions were restored in the impacted budgets, a letter of intent that those positions be utilized only for those limited purposes, and not for other than commissioned personnel, would be appropriate.

ASSEMBLY BILL (A.B.) 113:     Requires state fire marshal to establish mobile training team to train volunteer firemen to respond to incidents involving hazardous materials.

 

Mr. Stevens stated by processing A.B. ll3, funding would be provided in the form of a SERC [State Emergency Response Commission] grant to allow the state fire marshal to train volunteer fire departments to respond to hazardous material situations throughout the state.

Senator Raggio announced the decision of the Senate Committee on Finance was to keep this agency separate from the Benefits Division.

 

ASSEMBLY BILL (A.B.) 359:     Makes various changes regarding administration of program of deferred compensation for state employees.

 

Mr. Stevens stated the recommendation in the Executive Budget was to declare the Committee on Benefits assume responsibility for the Deferred Compensation program.  He pointed out the Assembly Committee on Ways and Means processed A.B. 359, which changed the Deferred Compensation program committee, "but left that intact where they would operate that program outside the Committee on Benefits. This would establish the budget that was requested by the Deferred Compensation Committee for their operations in each year of the biennium."
