      Sixty-seventh Session

The Senate Committee on Natural Resources was called to order by Chairman R. Hal Smith, at 8:44 a.m., on Friday, April 30, 1993, in Room 224 of the Legislative Building, Carson City, Nevada.  Exhibit A is the Meeting Agenda.  Exhibit B is the Attendance Roster.

Chairman Smith opened the work session on Senate Bill (S.B.) 348 and invited Senator Mike McGinness to present his testimony.

 

SENATE BILL 348:  Protects lessees of grazing in Carson Lake Pasture.

 

Senator McGinness introduced himself to members of the committee.  He proceeded to review an amendment, which the Subcommittee on Wildlife had requested he prepare.  Upon completing this review of the amendment, Senator McGinness stated all parties involved were in complete agreement and requested the Senate Committee on Natural Resources amend and do pass S.B. 348.

 

      SENATOR RHOADS MOVED TO AMEND AND DO PASS S.B. 348 AS AMENDED.

 

      SENATOR ADLER SECONDED THE MOTION.

SENATE BILL 363:  Revises requirements for approval by board of directors of district for control of floods of certain projects, improvements and proposals relating to control of floods.

 

Chairman Smith reminded those in attendance the Senate Committee on Natural Resources had not taken action on S.B. 363 at a previous hearing (Wednesday, April 14, 1993).  At that hearing, he had wanted to discuss the bill with John Swendseid, Bond Counsel for the Clark County Regional Flood Control District.  Chairman Smith commented he had received information from Mr. Swendseid indicating S.B. 363 did not present any kind of threat to present or future bond holders.

 

Chairman Smith called for action on S.B. 363.

 

      SENATOR RHOADS MOVED TO DO PASS S.B. 363.

 

      SENATOR ADLER SECONDED THE MOTION.

ASSEMBLY BILL (A.B.) 158:     Limits use of money by district for control of floods for certain off-site improvements.

 

Chairman Smith invited Virginia Valentine, Professional Engineer (P.E.), Chief Engineer and General Manager, Clark County Regional Flood Control District, to provide testimony on A.B. 158.  He recalled from the previous hearing on this bill (Wednesday, March 31, 1993), that Ms. Valentine had stated the Clark County Regional Flood Control District board had differing opinions on whether to support passage of A.B. 158.

 

Ms. Valentine introduced herself to members of the committee and stated a majority of the flood control board members did not support passage of A.B. 158.  She continued by clarifying the Clark County Regional Flood Control District supported the concept of the bill, but felt it would be more appropriate for the board to adopt this into policy, rather than have it enacted into statute.

 

Chairman Smith commented he really felt A.B. 158 was unnecessary.  Senator Rhoads concurred with Senator Smith's opinion.

Chairman Smith opened the work session on S.B. 114.

 

SENATE BILL 114:  Makes various changes to provisions governing possession, cultivation and propagation of live wildlife.

 

Senator Rhoads presented members of the committee with a massive amendment to S.B. 114 from the Subcommittee on Wildlife, which he chaired.  He stated all parties had reached a consensus and requested the committee's support of the amendment.

 

      SENATOR RHOADS MOVED TO AMEND AND DO PASS S.B. 114 AS AMENDED.

 

      SENATOR JAMES SECONDED THE MOTION.

 

      THE MOTION CARRIED.  (SENATORS HICKEY, NEAL AND TITUS WERE ABSENT FOR THE VOTE.)

 

Terry Crawforth, Deputy Director, Nevada Department of Wildlife (NDOW), drew attention to a couple of minor problems with the amendment which he and his staff had detected the day before the work session.

 

After considerable discussion, Senator Smith determined that it was too late to address any further amendments to S.B. 114.  He explained the bill had already been amended and passed out of the Senate Committee on Natural Resources.

 

Senator Rhoads recommended that Mr. Crawforth contact him later with his concerns, because S.B. 114 could be amended again on the senate floor.

SENATE BILL 124:  Makes various changes relating to standards for conservation of energy in buildings.

 

Chairman Smith pointed out he had held S.B. 124 for some period of time and stated he would accept a motion.

      SENATOR JAMES SECONDED THE MOTION.

Chairman Smith opened the work session on S.B. 229.

 

SENATE BILL 229:  Requires person to file report of accident involving vessel with department of wildlife before receiving payment of insurance claim.

 

Senator Adler drew attention to an amendment (Exhibit C), which had been supplied by the Nevada Department of Wildlife (NDOW).  He supported this amendment due to the fact it clarified the issue of giving notice to the insurer, as well as the NDOW, of a boating accident involving a collision and/or casualty.

 

Chairman Smith called for action on S.B. 229.

 

      SENATOR ADLER MOVED TO AMEND AND DO PASS S.B. 229 AS AMENDED.

 

      SENATOR JAMES SECONDED THE MOTION.

Senator Rhoads mentioned he had recently participated in a conference sponsored by the Energy, Environment and Natural Resource Task Force of the American Legislative Exchange Council (ALEC).  He passed out two booklets, entitled "Environmental Partners - A State Legislator's Guide to Public-Private Partnerships" (Exhibits D & E - originals in research library).

 

 

ASSEMBLY BILL 125:      Makes various changes relating to repository for information concerning hazardous materials in Nevada.

 

Chairman Smith mentioned he had hoped to take action on A.B. 125.  However, due to the fact Senator Hickey was not present at the work session, Senator Smith recommended the committee hold the bill for a later work session.

 

 

Chairman Smith said the next order of business before the committee was consideration of two bill draft requests (BDRs).

 

BDR 45-1971:      Increase required visits to traps, snares and other devises not designed to cause immediate death.

 

Chairman Smith called for action on BDR 45-1971.

 

      SENATOR ADLER MOVED FOR COMMITTEE INTRODUCTION OF BDR 45-1971.

 

      SENATOR JAMES SECONDED THE MOTION.

BDR 43-1213:      Clarifies responsibility for placement and permitting of buoys.

 

Chairman Smith called for action on BDR 43-1213.
