The Senate Committee on Transportation was called to order by Chairman William R. O'Donnell, at 1:48 p.m., on Tuesday, May 4, 1993, in Room 226 of the Legislative Building, Carson City, Nevada. Exhibit A is the Meeting Agenda. Exhibit B is the Attendance Roster.

Chairman O'Donnell opened the work session with Senate Bill (S.B.) 29.
Senate Bill 29: Expands certain definitions for purposes of sale and registration of motor vehicles.
Chairman O'Donnell explained the amendment to the bill. He said it allows the facilities who have long-term leasing businesses to continue to buy cars and resell them if necessary. He said the businesses would have to be zoned for such activities, have an office of at least 2000 square feet, have a lot capacity to display at least 20 vehicles for sale and a facility for repairing or performing maintenance on a vehicle. The maintenance facility must be at least 700 square feet, which is about two work bays.
Chairman O'Donnell asked for a motion on S.B. 29.
SENATOR NEVIN MOVED TO AMEND AND DO PASS S.B. 29 WITH AMENDMENT NUMBER 383.
SENATOR HICKEY SECONDED THE MOTION.
THE MOTION CARRIED. (SENATORS NEAL AND BROWN VOTED NO.)

Senator Brown asked to make a motion to add an amendment of her own. Senator Nevin explained to her that she could not make such a motion.
Chairman O'Donnel closed the work session on S.B. 29 and opened the work session on S.B. 126.
Senate Bill 126: Makes various changes to laws pertaining to controls of emissions from motor vehicles.
Chairman O'Donnell read the amendment to the bill. The committee then discussed the bill and the amendment.
Chairman O'Donnell asked for a motion on S.B. 126.
SENATOR JAMES MOVED TO AMEND AND RE-REFER S.B. 126 TO THE SENATE COMMITTEE ON NATURAL RESOURCES.
SENATOR HICKEY SECONDED THE MOTION.
THE MOTION CARRIED UNANIMOUSLY.

Chairman O'Donnell closed the work session on S.B. 126 and opened the work session on S.B. 382.
Senate Bill 382: Exempts postal service vehicles from prohibition against parking near public or private driveway.
Senator Nevin said it was a bad idea to include private delivery companies such as United Parcel Service (UPS).
Chairman O'Donnell asked for a motion on this bill.
SENATOR NEVIN MOVED TO DO PASS S.B. 382.
SENATOR JACOBSEN SECONDED THE MOTION.
THE MOTION CARRIED UNANIMOUSLY.

Chairman O'Donnell closed the work session on S.B. 382 and opened the work session on Assembly Bill (A.B.) 92.
Assembly Bill 92: Provides that driving while under influence of intoxicating liquor or controlled substance is punishable as felony if committed within 7 years after release from prison after serving any part of sentence imposed for certain offenses.
Chairman O'Donnell said this bill conflicts with A.B. 57 which has already been passed out of the committee and has been passed through both houses.
Assembly Bill 57: Clarifies procedure for obtaining involuntary samples of blood from certain persons suspected of driving under influence of controlled substance or alcohol.
Chairman O'Donnell asked for a motion on this bill.
SENATOR NEAL TO INDEFINITELY POSTPONE A.B. 92.
SENATOR NEVIN SECONDED THE MOTION.
THE MOTION CARRIED. (SENATOR BROWN VOTED NO.)

Chairman O'Donnell closed the work session on A.B. 92 and opened the work session on A.B. 138.
Assembly Bill 138: Revises provisions regarding speed limits in school zones and school crossing zones.
Chairman O'Donnell said he wanted to put this bill in subcommittee for further consideration.
No action was taken on this bill.
Chairman O'Donnell closed the work session on A.B. 138 and opened the work session on A.B. 157.
Assembly Bill 157: Makes various changes relating to driver's licenses and registration of motor vehicles.
Chairman O'Donnell read from the bill. The committee then discussed the bill.
No action was taken on this bill.
Chairman O'Donnell closed the work session on A.B. 157 and opened the work session on A.B. 229.
Assembly Bill 229: Expands and under certain circumstances makes mandatory provision regarding suspension of driver's license of juveniles who commit certain unlawful acts.
Chairman O'Donnell said he would put this bill in subcommittee with
Senators Nevin and Hickey and himself.
Chairman O'Donnell closed the work session on A.B. 229 and opened the work session on Assembly Concurrent Resolution (A.C.R.) 31.
Assembly Concurrent Resolution (A.C.R.) 31: Urges local governments to take certain action relating to school zones.
Chairman O'Donnell discussed the proposed amendment.
Senator said the amendment should say that the Nevada Department of Transportation (NDOT) should also have to work with the local governments.
Chairman O'Donnell said the words "work in cooperation" means work together, one with another. He said that was the intent of the language. He said the intent would be that NDOT would work with the local governments and the local governments would work with NDOT.
SENATOR BROWN MOVED TO AMEND AND DO PASS A.C.R. 31.
SENATOR NEVIN SECONDED THE MOTION.
THE MOTION CARRIED UNANIMOUSLY.
