AN ACT relating to meetings of public bodies; authorizing a member of a public body to request that an item of business be placed on the agenda for a future meeting of the body under certain circumstances; requiring the presiding officer to place the item on the agenda under certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1 Chapter 241 of NRS is hereby amended by adding thereto a new section to read as follows:
1. During the meeting of a public body, a member of the public body may request that an item of business be placed on its agenda for the next meeting if the body has legal authority to act upon the item or to advise another public body or officer regarding the item. Except as otherwise provided in subsection 2, if a member makes such a request, the presiding officer shall place the item on the agenda for the next meeting.
2. The presiding officer may deny a request to place an item of business on the agenda for the next meeting of the body if:
(a) The agenda for the next meeting has been finalized and preparatory materials for that meeting have been assembled;
(b) Placing the additional item on the agenda would not allow sufficient time for consideration of an item previously scheduled; or
(c) The request concerns an item upon which the body has previously taken final action.
3. If the presiding officer denies a request to place an item of business on the agenda for the next meeting of the body, he shall place the item on the agenda for the next meeting during which it is possible to hear the item. When placing an item on a future agenda pursuant to a request made pursuant to subsection 1, the presiding officer shall give preference to each request according to the order in which it was received.
