The Committee on Elections, Procedures, and Ethics was called to order at 5:30 p.m., on Wednesday, February 3, 1999. Chair Chris Giunchigliani presided in Room 3138 of the Legislative Building, Carson City, Nevada. Exhibit A is the Agenda. Exhibit B is the Guest List. All Exhibits are available and on file at the Research Library of the Legislative Counsel Bureau.

Chairwoman Giunchigliani called the meeting to order and introduced the Committee Secretary, Jodie Van Wyhe. She discussed the importance of committee members attendance due to the 5:30 p.m. start time and stated she would post the meeting time for after adjournment of the Commerce and Labor Committee. With the responsibility of elections and ethics issues coming before the committee, the Chair wanted the public to feel safe and not threatened in any way.

Chairwoman Giunchigliani complimented Assemblyman Price on his appointment to the newly formed Committee on Constitutional Amendments. As a result of the formation of that committee, Elections, Procedure, and Ethics Committee would not hear all types of issues it had heard previously.

Chairwoman Giunchigliani introduced Michael Stewart, Research Analyst, and Scott Wasserman, Committee Counsel, and welcomed all new members to the committee. The Chair also encouraged the audience to ask questions, interject, or offer comments when needed.

The Chair stated the Standing Committee Rules ( Exhibit C ) were before the committee and had been provided to members prior to the meeting for perusal. She asked if anyone had questions, changes, or anything to add. None did.

ASSEMBLYWOMAN TIFFANY MOVED TO ADOPT THE STANDING RULES FOR THE ASSEMBLY COMMITTEE ON ELECTIONS, PROCEDURES, AND ETHICS FOR THE SEVENTIETH SESSION.

SECONDED BY ASSEMBLYMAN PRICE.

MOTION CARRIED UNANIMOUSLY. ASSEMBLYMAN DINI WAS ABSENT FOR THE VOTE.

Chairwoman Giunchigliani stated copies of any information being discussed would be on the back table for the public. She reminded those who wanted to testify to make sure to sign in on the attendance sheet and requested those who testified and had handouts to bring enough copies for the committee plus 10 for the public. The Chairwoman reminded the public the sessions were recorded, and they are under oath. Because of the Internet hookup, if more than one person presented material at the same time, the person testifying would need to be identified again when speaking. She requested if the person speaking had a business card to please present it to the committee secretary.

 

 

Assemblywoman Tiffany asked about reapportionment of the legislature and its impact on this committee. Mr. Wasserman, Committee Counsel, explained the 1990 census gave an edge to the task because the legislature did not start from scratch. Street maps had already been sent, cleaned up, and returned to the Census Bureau. Redistricting numbers must be sent to states by April 1, 2001. Mr. Wasserman said the state would request receipt of the numbers earlier due to the shortened session. He explained Congress would still be debating on methods to do random sampling for the census count. In the past, an interim committee was formed to select computer vendors. An interim study could be formed again to select hardware and software for the 2001 session. Mr. Wasserman called attention to the fact there was money in the Legislative Counsel Bureau budget in the amount of $227,000 for costs related to redistricting computer needs.

Assemblywoman Tiffany asked about the relationship of Elections, Procedures, and Ethics Committee to a interim committee if one were established. Robert Erickson, Research director, testified that in 1991, the committee and Senate Government Affairs were the committees on redistricting. It appeared for the 2001 session, it would be this committee in the Assembly and Senate Legislative Affairs who would work on reapportionment.

Chairwoman Giunchigliani stated there were three BDRs to introduce.

BILL DRAFT REQUEST R 42 - AMENDS JOINT RULES OF SENATE AND ASSEMBLY TO RESTRICT INTRODUCTION AND CONSIDERATION OF CERTAIN LEGISLATION. THE CHAIR NOTED FOR THE RECORD THE BDR WAS DRAFTED AT HER REQUEST.

ASSEMBLYWOMAN MCCLAIN MOVED TO INTRODUCE BDR R 42.

ASSEMBLYWOMAN LESLIE SECONDED THE MOTION.

MOTION CARRIED UNANIMOUSLY. ASSEMBLYMAN DINI WAS ABSENT FOR THE VOTE.

BILL DRAFT REQUEST 24-857 - REPEALS CERTAIN PROVISIONS RELATED TO CAMPAIGNS. THE CHAIR NOTED FOR THE RECORD THIS BDR WAS DRAFTED AT HER REQUEST.

MOTION CARRIED UNANIMOUSLY. ASSEMBLYMAN DINI WAS ABSENT FOR THE VOTE.

Chairwoman Giunchigliani reintroduced Michael Stewart, Research Analyst for the Legislative Counsel Bureau. Mr. Stewart gave an overview of the legislative issues of Elections, Procedures, and Ethics, and every member was handed a copy of the overview ( Exhibit D ) Details were given to all previous measures, and the tables and the attachments were explained for this committee, and extra copies which would be on file at the Research Library. He included important information pertaining to committee deadlines for bills. He also included voter registration, turnout, election officer names, and a sheet to help the public contact their legislator. Assemblyman Price complimented Mr. Stewart on his work, stating it was very detailed.

Chairwoman Giunchigliani thanked him as well, commenting it was one of the best presentations she had seen from staff. The report contained a synopsis of past legislative measures passed by the committee. It also contained a section by section analysis of SB 215, campaign finance reform act of 1997. He also

 

 

 

provided names and addresses of all election clerks. She restated the committee would be scheduled to meet as soon as the Committee on Commerce and Labor adjourned, which may allow the meeting for Elections, Procedures, and Ethics to sometimes convene earlier.

The Chair asked if there were any questions. None asked. The meeting was adjourned at 6:20 p.m.
