The Committee on Judiciary was called to order at 11:00 a.m., on May 12, 1999, behind the bar of the Assembly by Chairman Bernie Anderson.

COMMITTEE MEMBERS PRESENT:

Senate Bill 30: Increases monetary limits relating to claims in justices’ courts. (BDR 1-1032)

Chairman Anderson proposed an additional amendment to clarify that the bill applied to all small claims cases filed on or after October 1, 1999. He noted if that language was not added, the small claims court would be flooded with motions to amend pending cases to the higher $5,000 limit. He further noted that would be a huge burden on the court and it would unfairly penalize many defendants.

ASSEMBLYWOMAN ANGLE SECONDED THE MOTION.

THE MOTION CARRIED.
