The Senate Committee on Judiciary was called to order by Chairman Mark A. James, at 8:43 p.m, on Saturday, May 29, 1999, on the Senate Floor of the Legislative Building, Carson City, Nevada. There was no Agenda. There was no Attendance Roster.

Chairman James opened the hearing with the consideration of Assembly Bill (A.B.) 287, heard previously this afternoon (May 29, 1999) in committee.

ASSEMBLY BILL 287: Revises provisions governing proceedings and awards in actions relating to eminent domain. (BDR 3-729)

SENATOR TITUS MOVED TO DO PASS A.B. 287.

SENATOR WIENER SECONDED THE MOTION.

Senator James disclosed that his law firm represents clients regarding eminent domain matters. This legislation, however, would affect all property owners in the same manner so he has no conflict in voting on the measure.

The committee next considered Assembly Bill (A.B.) 688, also heard previously this day.

ASSEMBLY BILL 688: Amends Assembly Bill No. 456 of 1999 Legislative Session. (BDR 11-1752)

SENATOR MCGINNESS SECONDED THE MOTION.

THE MOTION CARRIED. (SENATOR PORTER ABSTAINED FROM THE VOTE.)

Chairman James referred the committee to Assembly Bill (A.B.) 72.

ASSEMBLY BILL 72: Subjects certain transactions involving mortgage companies and notes secured by liens on real property to laws regulating securities. (BDR 7-1203)

Chairman James indicated that subsequent to the hearing on the bill this afternoon, the chairman of the Senate Committee on Commerce and Labor (Senator Randolph J. Townsend, Washoe County Senatorial District No. 4) and other interested parties raised concerns with the bill. They urged the committee to examine A.B. 72 in light of Assembly Bill (A.B.) 64, which addresses the same subject matter and will soon be referred to conference committee.

ASSEMBLY BILL 64: Revises provisions relating to mortgage companies and loans secured by liens on real property. (BDR 54-1204)

Chairman James agreed to review the report of the conference committee before taking action, if necessary, on A.B. 72.

The committee turned its attention to unfinished business associated with Senate Bill (S.B.) 481.

SENATE BILL 481: Makes various changes concerning controlled substances and impaired operation of vehicles and vessels. (BDR 4-1622)

SENATOR PORTER MOVED TO CONCUR WITH AMENDMENT NO. 893 TO S.B. 481.

SENATOR WIENER SECONDED THE MOTION.

THE MOTION CARRIED UNANIMOUSLY.
