The Senate Committee on Transportation was called to order by Chairman William R. O'Donnell, at 1:30 p.m., on Tuesday, February 9, 1999, in Room 2149 of the Legislative Building, Carson City, Nevada. Exhibit A is the Agenda. Exhibit B is the Attendance Roster. All exhibits are available and on file at the Research Library of the Legislative Counsel Bureau.

Chairman O’Donnell announced to the committee members and others present that the agenda for today will be rescheduled for Tuesday, February 16, 1999.
Chairman O’Donnell continued a brief meeting by introducing several bill draft requests (BDRs).
Chairman O’Donnell introduced BDR 43-340 and stated this bill was submitted by "Former Senator John (Jack) B. Regan."
BILL DRAFT REQUEST 43-340: Removes provision that prohibits failure to wear safety belt from being considered negligence or causation in a civil action. (Later introduced as Senate Bill 151.)
SENATOR SHAFFER MOVED TO INTRODUCE BDR 43-340.
SENATOR WASHINGTON SECONDED THE MOTION.
THE MOTION CARRIED UNANIMOUSLY.

BILL DRAFT REQUEST 43-275: Revises definition regarding minimum content of alcohol required to be in blood or breath of person to be considered driving under the influence of intoxicating liquor. (Later introduced as Senate Bill 152.)

BILL DRAFT REQUEST 43-357: Proposes to exclude from calculation of certain taxes on retail sales fees charged by retailer for documents that are required to complete sale of vehicle. (Later introduced as Senate Bill 156.)

Chairman O’Donnell stated that BDR 43-193 was submitted by the trucking industry, and the committee passed a bill called the "Lemon Law" last session. Chairman O’Donnell said that the trucking industry requested to be exempt from the "Lemon Law" because they discovered trucks exceed the gross vehicle weight and are driven 75,000 miles within months. He pointed out this data was provided by Daryl Capurro, Lobbyist, Nevada Motor Transport Association.
BILL DRAFT REQUEST 43-193: Revise definition of "used vehicle" as used in provisions concerning sale of certain used vehicles. (Later introduced as Senate Bill 153.)
SENATOR WASHINGTON MOVED TO INTRODUCE BDR 43-193.
SENATOR SHAFFER SECONDED THE MOTION.
