The Senate Committee on Transportation was called to order by Chairman William R. O'Donnell, at 2:40 p.m., on Tuesday, April 13, 1999, in Room 2149 of the Legislative Building, Carson City, Nevada. This meeting was video conferenced to the Grant Sawyer Building, 555 East Washington Avenue, Room 4412, Las Vegas, Nevada. Exhibit A is the Agenda. Exhibit B is the Attendance Roster. Chairman O’Donnell opened the hearing on Assembly Bill (A.B.) 59.
ASSEMBLY BILL 59: Clarifies that person with disability may obtain special license plate and parking sticker to park motorcycle in space designated for handicapped. (BDR 43-132)
Danielle M. Kohler, Lobbyist, ABATE (A Brotherhood Aimed Toward Education) of Nevada, testified in favor of A.B. 59. Ms. Kohler presented a letter from ABATE of Nevada (Exhibit C) as well as a letter from David Joe Brown (Exhibit D) urging the passage of A.B. 59. Ms. Kohler reiterated the need for handicapped parking for motorcycle riders.
Gary Horrocks, Lobbyist, Nevada Association of Concerned Motorcyclists, testified in favor of A.B. 59. Mr. Horrocks proposed an amendment to the bill which would create a smaller sticker for the license plate than originally designed. A 1" decal has been provided to the Department of Motor Vehicles & Public Safety (DMV&PS), which would be more appropriate in size on the motorcycle. Chairman O’Donnell asked Mr. Horrocks if A.B. 59 presently requires a 3" sticker to be placed on the front of the motorcycle. Mr. Horrocks responded the 3" decal would overwhelm the license plate and indicated the 1" decal would fit the motorcycle more appropriately.
Senator Jacobsen asked Mr. Horrocks if other options would be available to affix a 3" sticker elsewhere on the motorcycle. Mr. Horrocks demonstrated the approximate size and what space would be taken up by placing the 3" decal on the plate. If the license plate was to be embossed with relief rather than a sticker it would be very costly to the state of Nevada. Mr. Horrocks noted that by affixing a 3" decal it would cover one number on the license plate.
Senator Wiener asked Chairman O’Donnell exactly what line and section of the bill was being amended. Mr. Horrocks responded the 3" sizing noted on line 18 refers to the temporary sticker or someone with a short-term or time-limited disability; however, what A.B. 59 pertains to is someone who has a permanent disability.
Chairman O’Donnell closed the hearing on A.B. 59 and opened the hearing on Assembly Bill (A.B.) 188.
ASSEMBLY BILL 188: Revises grounds for denying, suspending or revoking license to engage in activity of broker of vehicles. (BDR 43-753)
Russell Benzler, Chief Investigator, Bureau of Enforcement, Registration Division, Department of Motor Vehicles and Public Safety (DMV&PS), testified on A.B. 188, which was requested by DMV&PS. A.B. 188 has been requested to standardize the statutes pertaining to regulated business, wherever possible. A.B. 188 seeks to amend the provisions of Nevada Revised Statutes (NRS) 482.333. Mr. Benzler referred to NRS 482.351, in the Vehicle Licensing, Registration chapter (Exhibit E).
Chairman O’Donnell noted a serious problem exists with DMV&PS providing broker licenses to individual’s who claim to have a place of business, which eliminates a registration fee with the dealer license plate.
Wayne A. Frediani, Lobbyist, Nevada Franchised Auto Dealers Association, testified in support of A.B. 188. Mr. Frediani stated the same law should apply to auto brokers as to auto franchised dealers.
Chairman O’Donnell closed the hearing on A.B. 188 and opened the hearing on Assembly Bill (A.B.) 410.
ASSEMBLY BILL 410: Repeals certain requirements relating to submission of statement concerning compliance with court order for child support as condition to issuance or renewal of driver’s license. (BDR 43-448)
Myla C. Florence, Administrator, Welfare Division, Department of Human Resources, testified regarding the renewal or obtaining of driver’s license requirements pertaining to the child support program. Ms. Florence proposed a language change to A.B. 410 and it no longer pertains to the child-support program. Sections 1 and 2 delete language for an individual, obtaining or renewing a license, to submit a statement in compliance with the child-support enforcement program. The language is not needed because prior to the implementation of the national welfare reform laws of 1996, system matches between the Welfare Division and the Department of Motor Vehicles and Public Safety were in place to identify individuals who are not in compliance with their child-support obligations.
Chairman O’Donnell closed the hearing on A.B. 410 and opened the hearing on Assembly Bill (A.B.) 452.
ASSEMBLY BILL 452: Prohibits inclusion of certain statements regarding mileage in certificates of ownership of certain vehicles and revises provisions concerning salvage of vehicles. (BDR 43-1110)
Chairman O’Donnell disclosed he had purchased salvage items from Mr. Ellis of Snap Towing.
John E Jeffrey, Lobbyist, B and E Auto Auction, testified A.B. 452 changes the title from Certificate of Dismantling to Salvage Title. The other provisions of this bill remain unchanged. Mr. Jeffrey testified in favor of A.B. 452.
Keith E. Lynam, Lobbyist, Nevada Auto Trade Association, testified in opposition to A.B. 452.
Allan Bloomberg, Concerned Citizen, Ray’s Auto Wrecking, testified from the Grant Sawyer State Office Building, Las Vegas, in opposition to A.B. 452.
John Fadgen, B and E Auto Auction, representing Mr. Ellis, testified in favor of A.B. 452.
Richard C. Goodwell, Copart Salvage Auto Auctions, testified in support of A.B. 452. Mr. Goodwell stated other states use some type of salvage certificate and this bill will make title processing more uniform for Nevada.
Chairman O’Donnell closed the hearing on A.B. 452. Chairman O’Donnell informed the committee Senate Bill (S.B.) 491 will be heard during Senate Floor Session tomorrow, April 14, 1999. Senator O’Donnell stated Brenda J. Erdoes, Legislative Counsel, Legal Division, Legislative Counsel Bureau, had informed the chairman there was a problem with the proposed amendment to S.B. 491. A diversion cannot be made illegal in one county and not in the others.
SENATE BILL 491: Makes various changes relating to regulation of common and contract motor carriers, operators of tow cars, carriers of household goods, taxicab motor carriers and limousine motor carriers. (BDR 58-1606)
