(c) All swine or animals of the porcine species.4-11
(d) All goats or animals of the caprine species.4-12
(e) All poultry or domesticated fowl or birds.4-13
(f) All dogs, cats or other animals domesticated or under the restraint or4-14

Sec. 8. NRS 561.035 is hereby amended to read as follows: 561.035 1. The department of agriculture of the State of Nevada is4-17

2. The administration of the provisions of this chapter is vested in the4-19

Sec. 9. NRS 561.045 is hereby amended to read as follows: 561.045 There is hereby created in the4-22
board of agriculture composed of 10 members appointed by the governor.4-23
Sec. 10. NRS 561.075 is hereby amended to read as follows: 561.075 1. While engaged in the business of the4-25
department, each member of the board is entitled to receive a salary of not4-26
more than $80 per day, as fixed by the board.4-27

member and employee of the board is entitled to receive the per diem4-29
allowance and travel expenses provided for state officers and employees4-30

3. The salaries, per diem allowances and travel expenses of the4-32

remove the person from office with the approval of the board.5-40
Sec. 18. NRS 561.218 is hereby amended to read as follows: 561.218 1. The5-42
manage the activities of the5-43
resources, land use planning and the management and control of wild6-1
horses and estrays. The person must be appointed on the basis of merit and6-2
is in the unclassified service. The6-3

(a) Establish and carry out a policy for the management and control of6-6
estrays and the preservation and allocation of natural resources necessary6-7
to advance and protect the livestock and agricultural industries in this state.6-8
(b) Develop cooperative agreements and working relationships with6-9
federal and state agencies and local governments for land use planning and6-10
the preservation and allocation of natural resources necessary to advance6-11
and protect the livestock and agricultural industries in this state.6-12
(c) Cooperate with private organizations and governmental agencies to6-13
develop procedures and policies for the management and control of wild6-14
horses.6-15
(d) Monitor gatherings of estrays conducted pursuant to the provisions6-16
of NRS 569.040 to 569.130, inclusive, and assist district brand inspectors6-17
in identifying estrays before they are sold or given a placement or other6-18
disposition through a cooperative agreement established pursuant to NRS6-19
569.031.6-20
(e) Provide the general public with information relating to the activities6-21
of the6-22
public and advisory groups concerning those activities.6-23
(f) Make assessments of the level of competition between livestock and6-24
wildlife for food and water, collect data concerning the movement of6-25
livestock and perform activities necessary to control noxious weeds.6-26
(g) Participate in land use planning relating to the competition for food6-27
and water between livestock and wildlife to ensure the maintenance of the6-28
habitat of both livestock and wildlife.6-29
(h) Present testimony, conduct research and prepare reports for the6-30
governor, the legislature, the6-31
or governmental entity as directed by the6-32
(i) Develop and carry out a program to educate the public concerning6-33
the various programs administered by the6-34
programs for the management and control of estrays.6-35
(j) Make proposals to the6-36
the regulations adopted by the board pursuant to NRS 561.105.6-37
(k) Perform such other duties as directed by the6-38
director.6-39
3. As used in this section:6-40
(a) "Estray" has the meaning ascribed to it in NRS 569.005.6-41
(b) "Wild horse" has the meaning ascribed to it in NRS 504.430.6-42
Sec. 19. This act becomes effective on July 1, 1999.7-1
Sec. 20. The legislative counsel shall:7-2
1. In preparing the reprint and supplements to the Nevada Revised7-3
Statutes, with respect to any section that is not amended by this act or is7-4
further amended by another act, appropriately change any reference to:7-5
(a) "Division of minerals" to "department of minerals";7-6
(b) "Division of agriculture" to "department of agriculture"; and7-7
(c) Any other agency or any officer whose name is changed or whose7-8
responsibilities have been transferred pursuant to the provisions of this act7-9
to refer to the appropriate agency or officer.7-10
2. In preparing supplements to the Nevada Administrative Code,7-11
appropriately change any reference to:7-12
(a) "Division of minerals" to "department of minerals";7-13
(b) "Division of agriculture" to "department of agriculture"; and7-14
(c) Any other agency or any officer whose name is changed or whose7-15
responsibilities have been transferred pursuant to the provisions of this act7-16
to refer to the appropriate agency or officer.~
