AN ACT relating to watercraft; increasing the threshold amount of property damage at which an operator is required to report a casualty involving his vessel; requiring the division of wildlife of the state department of conservation and natural resources to investigate certain casualties; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 488.550 is hereby amended to read as follows:

1-2 488.550 1. The operator of a vessel involved in a collision, accident

1-3 or other casualty shall, so far as he can do so without serious danger to his

1-4 own vessel, crew and passengers, render to other persons affected by the

1-5 casualty such assistance as may be practicable and as may be necessary to

1-6 save them from or minimize any danger caused by the casualty, and shall

1-7 give his name, address and the identification of his vessel in writing to any

1-8 person injured and to the owner of any property damaged in the casualty.

1-9 2. In the case of collision, accident or other casualty involving a vessel,

1-10 the operator thereof, if the casualty results in death or injury to a person or

1-11 damage to property in excess of [$200,] $500, shall file with the division of

1-12 wildlife of the state department of conservation and natural resources a full

2-1 description of the casualty, including , without limitation, such information

2-2 as the commission may, by regulation, require.

2-3 3. Upon receipt of a claim under a policy of insurance with respect to a

2-4 collision, accident or other casualty for which a report is required by

2-5 subsection 2, the insurer shall provide written notice to the insured of his

2-6 responsibility pursuant to subsection 2 to file with the division of wildlife a

2-7 full description of the casualty.

2-8 4. Upon receipt of a request for repair with respect to a collision,

2-9 accident or other casualty for which a report is required by subsection 2,

2-10 the person who repairs the vessel shall provide written notice to the person

2-11 requesting the repairs of the requirement set forth in subsection 2 that the

2-12 operator file with the division of wildlife a full description of the casualty.

2-13 5. The insurer and the person who repairs a vessel shall transmit a copy

2-14 of each notice they provide pursuant to subsections 3 and 4, respectively, to

2-15 the division of wildlife at the same time [it] the notice is provided to the

2-16 insured or person requesting the repairs.

2-17 6. The division of wildlife shall investigate or cause to be investigated

2-18 a collision, accident or other casualty involving a vessel which results in

2-19 death or substantial bodily injury and shall gather evidence to be used in

2-20 the prosecution of a person charged with violating a law in connection

2-21 with the collision, accident or other casualty. The division of wildlife may

2-22 investigate or cause to be investigated a collision, accident or other

2-23 casualty involving a vessel which does not result in death or substantial

2-24 bodily injury and may gather evidence to be used in the prosecution of a

2-25 person charged with violating a law in connection with the collision,

2-26 accident or other casualty.
