AN ACT relating to education; excluding institutions or persons who offer certain computer software training programs from regulation as a postsecondary educational institution; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 394.099 is hereby amended to read as follows:

1-2 394.099 "Postsecondary educational institution" means an academic,

1-3 vocational, technical, home study, business, professional or other school,

1-4 college or university that is privately owned, or any person offering

1-5 postsecondary education if he:

1-6 1. Is not licensed as a postsecondary educational institution in this

1-7 state by a federal or another state agency;

1-8 2. Charges tuition, requires or requests donations or receives any

1-9 consideration from a student for any portion of the instruction, including

1-10 written or audiovisual material;

1-11 3. Educates or trains persons who are not his employees; and

1-12 4. Educates or trains, or claims or offers to educate or train, students in

1-13 a program leading toward:

1-14 (a) Employment at a beginning or advanced level;

1-15 (b) Educational credentials;

1-16 (c) Credits that are intended to be applied toward an educational

1-17 credential awarded in another state which does not require the person to

1-18 obtain a majority of the credits required in that state; or

2-1 (d) Preparation for examinations for initial licensing in a profession or

2-2 vocation . [,

2-3 but] The term includes a branch or extension of a public or private

2-4 postsecondary educational institution of another state [,] that is located in

2-5 this state or which offers educational services or education in this state . [is

2-6 a postsecondary educational institution.] The term does not include an

2-7 institution or person offering educational services or programs on the

2-8 use of computer software if the services or programs are not longer than

2-9 12 hours.
