AN ACT relating to the legislature; providing for a supplemental allowance to certain legislators who maintain temporary quarters in Carson City during a legislative session; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 218 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. In addition to any payment received pursuant to NRS 218.220,

1-4 during each regular and special legislative session each senator and

1-5 assemblyman:

1-6 (a) Whose home is more than 50 miles from Carson City; and

1-7 (b) Who maintains temporary quarters in or near Carson City for

1-8 which he has entered into a lease or other agreement for occupancy

1-9 during a legislative session,

1-10 is entitled to receive a supplemental allowance to reimburse the legislator

1-11 for the cost of additional housing. The supplemental allowance must be

1-12 paid at the end of each month during the legislative session in the

1-13 amount set forth in subsection 2 beginning the month of the first day of

1-14 the legislative session and ending the month of the adjournment sine die

1-15 of the legislative session, inclusive.

1-16 2. The amount of the payment pursuant to subsection 1 is the fair

1-17 market rent for a one bedroom unit in Carson City as published by the

1-18 United States Department of Housing and Urban Development prorated

1-19 for the number of days of the month that the senator or assemblyman

2-1 actually maintained temporary quarters in or near Carson City. For the

2-2 purposes of this subsection, any day before the first day of the legislative

2-3 session or after the day of the adjournment sine die of the legislative

2-4 session may not be counted as a day for which the senator or

2-5 assemblyman actually maintained temporary quarters in or near Carson

2-6 City.

2-7 3. Except as otherwise provided in NRS 218.644, claims for

2-8 supplemental allowance under the provisions of this section must be

2-9 made as other claims are made against the state, and must be paid from

2-10 the legislative fund.
