AN ACT relating to hazardous materials; prohibiting the sale or use of certain highly flammable refrigerants; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 459 of NRS is hereby amended by adding thereto

1-2 a new section to read as follows:

1-3 1. A person shall not use, sell or offer to sell a product that is

1-4 intended for use as a refrigerant for the air-conditioning system of a

1-5 motor vehicle or a residential, commercial or industrial structure or for a

1-6 refrigerator or other cooling or heating device unless the product:

1-7 (a) Has been approved for the intended use by the United States

1-8 Environmental Protection Agency; or

1-9 (b) Complies with one of the following standards of flammability:

1-10 (1) SAE J639 or SAE J1657 of the Society of Automotive

1-11 Engineers;

1-12 (2) ASHRAE Standard 34-1992 of the American Society of

1-13 Heating, Refrigerating and Air Conditioning Engineers, Inc.;

1-14 (3) UL 2182 of the Underwriters Laboratories Inc.; or

1-15 (4) ASTM E681-85 of the American Society for Testing and

1-16 Materials.

2-1 2. A person who violates the provisions of subsection 1 is guilty of a

2-2 misdemeanor.

2-3 Sec. 2. The amendatory provisions of this act do not apply to offenses

2-4 that are committed before October 1, 1999.
