AN ACT relating to highways; requiring the director of the department of transportation to establish standards for the construction and maintenance of highways that comply with the standards of the local government where such construction or maintenance is being performed; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 408.200 is hereby amended to read as follows:

1-2 408.200 1. The director shall investigate and determine the methods

1-3 of [highway construction] constructing highways best adapted to the

1-4 various sections of the state, and shall establish standards and

1-5 specifications for the construction and maintenance of the highways,

1-6 giving due regard to the topography, natural conditions, character and

1-7 availability of [road-building materials.] materials used to build roads. If

1-8 the governing body of a local government has adopted standards and

1-9 specifications for the construction and maintenance of highways within

1-10 its jurisdiction, the director shall establish standards and specifications

1-11 for the construction and maintenance of highways within that

1-12 jurisdiction that are at least as stringent as the standards and

1-13 specifications adopted by the local government.

2-1 2. The director may construct, reconstruct, operate and maintain

2-2 [materials testing and research] laboratory facilities to research and test

2-3 materials as may be necessary to establish and maintain such standards

2-4 and specifications.

2-5 3. [The director may be consulted by county] County officials,

2-6 including members of regional transportation commissions, having

2-7 authority over streets and highways within their respective counties may

2-8 consult with the director relative to any question involving such streets

2-9 and highways . [; and the] The director may [, in like manner,] obtain from

2-10 such county officials all such information or assistance as they may render

2-11 in the performance of his duties with their county, and such county

2-12 officials shall supply such information when requested by the director.

2-13 Sec. 2. This act becomes effective upon passage and approval.
