AN ACT relating to traffic laws; prohibiting a truck, commercial vehicle or combination of commercial vehicles from being driven in the left lane of a highway under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.305 is hereby amended to read as follows:

1-2 484.305 1. [Whenever any] If a highway has two or more clearly

1-3 marked lanes for traffic traveling in one direction, vehicles [shall] must be

1-4 driven as nearly as practicable entirely within a single lane and [shall] must

1-5 not be moved from [such] that lane until the driver has given the

1-6 appropriate turn signal and ascertained that such movement can be made

1-7 with safety.

1-8 2. Upon a highway which has been divided into three clearly marked

1-9 lanes , a vehicle [shall] must not be driven in the extreme left lane at any

1-10 time. A vehicle on such a highway [shall] must not be driven in the center

1-11 lane except:

1-12 (a) When overtaking and passing another vehicle where the highway is

1-13 clearly visible and [such] the center lane is clear of traffic for a safe

1-14 distance;

1-15 (b) In preparation for a left turn; or

2-1 (c) Where [such] the center lane is at the time allocated exclusively to

2-2 traffic moving in the direction in which the vehicle is proceeding, and is

2-3 posted to give notice of such allocation.

2-4 3. [Whenever] If a highway has been designed to provide a single

2-5 center lane to be used only for turning, by traffic moving in both

2-6 directions, the following rules apply:

2-7 (a) A vehicle [shall] must be driven in the center turn lane only [for the

2-8 purpose of making] to make a left-hand turn.

2-9 (b) A vehicle [shall] must not travel more than 200 feet in a center turn

2-10 lane [prior to] before making a left-hand turn.

2-11 4. If a highway has three or more clearly marked lanes for traffic

2-12 traveling in one direction, a truck, commercial vehicle, or combination of

2-13 vehicles, that has a gross vehicle weight rating or gross combination

2-14 weight rating of 26,000 pounds or more must not be driven in the

2-15 extreme left lane except:

2-16 (a) When directed to do so by a law enforcement officer, an employee

2-17 of the department of transportation or an employee of the county road

2-18 supervisor or board of road commissioners of the county in which the

2-19 highway is located;

2-20 (b) When highway conditions and safety indicate that travel in the

2-21 extreme left lane is warranted; or

2-22 (c) In preparation for a left turn or U-turn.

2-23 5. If a highway has two clearly marked lanes for traffic traveling in

2-24 one direction, a truck, commercial vehicle, or combination of vehicles,

2-25 that has a gross vehicle weight rating or gross combination weight rating

2-26 of 26,000 pounds or more must not be driven in the left lane except:

2-27 (a) When overtaking and passing another vehicle proceeding in the

2-28 same direction under the laws governing such movements;

2-29 (b) When the right lane is closed to traffic;

2-30 (c) When directed to do so by a law enforcement officer, an employee

2-31 of the department of transportation or an employee of the county road

2-32 supervisor or board of road commissioners of the county in which the

2-33 highway is located; or

2-34 (d) When highway conditions and safety indicate that travel in the left

2-35 lane is warranted.

2-36 6. As used in this section:

2-37 (a) "Gross combination weight rating" means:

2-38 (1) The value specified by the manufacturer as the loaded weight of

2-39 a combination of vehicles; or

2-40 (2) In the absence of a value specified by the manufacturer, a value

2-41 determined by the total weight of all vehicles in the combination of

2-42 vehicles and the loads on those vehicles.

3-1 (b) "Gross vehicle weight rating" means the value specified by the

3-2 manufacturer as the loaded weight of a single motor vehicle.

3-3 (c) "Law enforcement officer" means:

3-4 (1) A police officer;

3-5 (2) An officer of a unit for the enforcement of nonmoving traffic

3-6 laws established pursuant to NRS 280.125; or

3-7 (3) Any other law enforcement officer designated by a board of

3-8 county commissioners of the county or the governing body of the city in

3-9 which a highway is located.
