AN ACT relating to driver education; revising provisions governing the requirements for licensure as an operator of or instructor for a school for training drivers; requiring applicants for licensure as operators of or instructors for schools for training drivers to submit their fingerprints for processing by the Federal Bureau of Investigation; abolishing the requirement that such persons hold a driving instructor’s certificate issued by the state department of education; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 483.710 is hereby amended to read as follows:

1-2 483.710 An applicant for a license to operate a school for training

1-3 drivers must:

1-4 1. Be of good moral character [.] , as determined in accordance with

1-5 criteria set forth in regulations adopted by the department.

1-6 2. Maintain an established place of business open to the public which

1-7 is not within 200 feet of any building used by the department as an office.

1-8 3. Have the equipment necessary to give proper instruction in the

1-9 operation of motor vehicles.

1-10 4. Be 21 years of age or older.

1-11 5. [Hold a valid driving instructor’s certificate issued by the state

1-12 department of education in accordance with regulations prescribed by the

2-1 state board of education governing the qualifications of instructors in

2-2 privately owned schools for training drivers.] For initial licensure, submit

2-3 with his application a complete set of his fingerprints and written

2-4 permission authorizing the department to forward those fingerprints to

2-5 the central repository for Nevada records of criminal history for

2-6 submission to the Federal Bureau of Investigation for its report.

2-7 6. Submit a fee for the processing of fingerprints submitted pursuant

2-8 to subsection 5. The department shall establish by regulation the fee for

2-9 processing fingerprints. The fee must not exceed the sum of the amounts

2-10 charged by the central repository for Nevada records of criminal history

2-11 and the Federal Bureau of Investigation for processing the fingerprints.

2-12 7. File with the department a surety bond in the amount of $10,000 to

2-13 the department, executed by the applicant as principal with a corporation

2-14 authorized to transact surety business in this state as surety. The bond must

2-15 be continuous in form and conditioned that the operator conduct the

2-16 business of the school as an instructional institution without fraud or

2-17 fraudulent representation. Upon application by an operator, the department

2-18 may reduce the amount of the bond required to an amount not less than

2-19 $5,000 if the operator has satisfactorily conducted his school for the 5

2-20 years immediately preceding the application for reduction.

2-21 Sec. 2. NRS 483.720 is hereby amended to read as follows:

2-22 483.720 An applicant for a license as an instructor for a school for

2-23 training drivers must:

2-24 1. Be of good moral character [;] , as determined in accordance with

2-25 criteria set forth in regulations adopted by the department;

2-26 2. Pass such examination as the department may require on traffic

2-27 laws, safe driving practices and operation of motor vehicles;

2-28 3. Be physically able to operate a motor vehicle safely and train others

2-29 in the operation of motor vehicles;

2-30 4. Hold a valid Nevada driver’s license;

2-31 5. Be 21 years of age or older; [and

2-32 6. Hold a valid driving instructor’s certificate issued by the state

2-33 department of education in accordance with regulations prescribed by the

2-34 state board of education governing the qualifications of instructors in

2-35 privately owned schools for training drivers.]

2-36 6. For initial licensure, submit with his application a complete set of

2-37 his fingerprints and written permission authorizing the department to

2-38 forward those fingerprints to the central repository for Nevada records of

2-39 criminal history for submission to the Federal Bureau of Investigation

2-40 for its report; and

3-1 7. Submit a fee for the processing of fingerprints submitted pursuant

3-2 to subsection 6. The department shall establish by regulation the fee for

3-3 processing fingerprints. The fee must not exceed the sum of the amounts

3-4 charged by the central repository for Nevada records of criminal history

3-5 and the Federal Bureau of Investigation for processing the fingerprints.

3-6 Sec. 3. This act becomes effective upon passage and approval.
