THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 483.710 is hereby amended to read as follows: 483.710 An applicant for a license to operate a school for training1-3
drivers must:1-4
1. Be of good moral character1-5
criteria set forth in regulations adopted by the department.1-6
2. Maintain an established place of business open to the public which1-7
is not within 200 feet of any building used by the department as an office.1-8
3. Have the equipment necessary to give proper instruction in the1-9
operation of motor vehicles.1-10
4. Be 21 years of age or older.1-11

with his application a complete set of his fingerprints and written2-4
permission authorizing the department to forward those fingerprints to2-5
the central repository for Nevada records of criminal history for2-6
submission to the Federal Bureau of Investigation for its report.2-7
6. Submit a fee for the processing of fingerprints submitted pursuant2-8
to subsection 5. The department shall establish by regulation the fee for2-9
processing fingerprints. The fee must not exceed the sum of the amounts2-10
charged by the central repository for Nevada records of criminal history2-11
and the Federal Bureau of Investigation for processing the fingerprints.2-12
7. File with the department a surety bond in the amount of $10,000 to2-13
the department, executed by the applicant as principal with a corporation2-14
authorized to transact surety business in this state as surety. The bond must2-15
be continuous in form and conditioned that the operator conduct the2-16
business of the school as an instructional institution without fraud or2-17
fraudulent representation. Upon application by an operator, the department2-18
may reduce the amount of the bond required to an amount not less than2-19
$5,000 if the operator has satisfactorily conducted his school for the 52-20
years immediately preceding the application for reduction.2-21
Sec. 2. NRS 483.720 is hereby amended to read as follows: 483.720 An applicant for a license as an instructor for a school for2-23
training drivers must:2-24
1. Be of good moral character2-25
criteria set forth in regulations adopted by the department;2-26
2. Pass such examination as the department may require on traffic2-27
laws, safe driving practices and operation of motor vehicles;2-28
3. Be physically able to operate a motor vehicle safely and train others2-29
in the operation of motor vehicles;2-30
4. Hold a valid Nevada driver’s license;2-31
5. Be 21 years of age or older;2-32

6. For initial licensure, submit with his application a complete set of2-37
his fingerprints and written permission authorizing the department to2-38
forward those fingerprints to the central repository for Nevada records of2-39
criminal history for submission to the Federal Bureau of Investigation2-40

7. Submit a fee for the processing of fingerprints submitted pursuant3-2
to subsection 6. The department shall establish by regulation the fee for3-3
processing fingerprints. The fee must not exceed the sum of the amounts3-4

Sec. 3. This act becomes effective upon passage and approval.~
