AN ACT relating to traffic laws; limiting the speed at which a vehicle may be driven on a street or highway which has been marked or posted with signs for the requirement of traction devices, tire chains or snow tires; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.375 is hereby amended to read as follows:

1-2 484.375 1. It is unlawful for any person to drive any vehicle

1-3 equipped with solid rubber or cushion tires at a speed which is greater than

1-4 10 miles per hour.

1-5 2. It is unlawful for any person to drive a vehicle on a street or

1-6 highway marked or posted with signs for the requirement of traction

1-7 devices, tire chains or snow tires pursuant to NRS 484.643 at a speed

1-8 which is greater than:

1-9 (a) The maximum speed which can be maintained with safety; or

1-10 (b) Thirty-five miles per hour,

1-11 whichever is less.

2-1 3. It is unlawful for any person to drive a vehicle over any bridge or

2-2 other elevated structure constituting a part of a highway at a speed which is

2-3 greater than the maximum speed which can be maintained with safety to

2-4 the bridge or structure, when such structure is signposted as provided in

2-5 [this section.

2-6 3.] subsection 4.

2-7 4. The department of transportation , upon request from any local

2-8 authority shall, or upon its own initiative may, conduct an investigation of

2-9 any bridge or other elevated structure constituting a part of a highway

2-10 constructed and maintained under the authority granted by chapter 408 of

2-11 NRS, and if it thereupon finds that such structure cannot with safety to

2-12 itself withstand vehicles traveling at the speed otherwise permissible under

2-13 this chapter, the department shall determine and declare the maximum

2-14 speed of vehicles which such structure can safely withstand, and shall

2-15 cause or permit suitable signs stating [such] the maximum speed to be

2-16 erected and maintained at a distance of 100 feet before each end of such

2-17 structure.

2-18 [4.] 5. Upon the trial of any person charged with a violation of

2-19 subsection 3 of this section, proof of the determination of the maximum

2-20 speed by the department and the existence of such signs as are required by

2-21 subsection 4 constitutes conclusive evidence of the maximum speed which

2-22 can be maintained with safety to the bridge or structure.
