AN ACT relating to motor vehicles; eliminating the requirement that the driver and passenger of a motorcycle being driven on a highway wear protective headgear; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 486.231 is hereby amended to read as follows:

1-2 486.231 1. The department shall adopt standards for [protective

1-3 headgear and] protective glasses, goggles or face shields to be worn by the

1-4 drivers and passengers of motorcycles and transparent windscreens for

1-5 motorcycles.

1-6 2. [Except as provided in this section, when] When any motorcycle,

1-7 except a trimobile , [or moped,] is being driven on a highway, the driver

1-8 and passenger shall wear [protective headgear securely fastened on the

1-9 head and] protective glasses, goggles or face shields meeting those

1-10 standards. Drivers and passengers of trimobiles shall wear protective

1-11 glasses, goggles or face shields which meet those standards.

2-1 3. When a motorcycle or a trimobile is equipped with a transparent

2-2 windscreen meeting those standards, the driver and passenger are not

2-3 required to wear protective glasses, goggles or face shields.

2-4 4. When a motorcycle is being driven in a parade authorized by a local

2-5 authority, the driver and passenger are not required to wear the protective

2-6 devices provided for in this section.

2-7 5. When a three-wheel motorcycle [,] on which the driver and

2-8 passengers ride within an enclosed cab [,] is being driven on a highway,

2-9 the driver and passengers are not required to wear the protective devices

2-10 required by this section.

2-11 Sec. 2. NRS 486.241 is hereby amended to read as follows:

2-12 486.241 1. A person shall not sell, offer for sale or distribute any

2-13 protective [headgear,] glasses, goggles or face shields for use by any

2-14 drivers or passengers of motorcycles or transparent windscreens for

2-15 motorcycles unless the equipment is of a type and specification meeting

2-16 the standards therefor adopted by the department.

2-17 2. The provisions of this section do not prohibit the sale of protective

2-18 [headgear,] glasses, goggles or face shields which comply with the rules

2-19 and regulations adopted by the United States Department of

2-20 Transportation.
