AN ACT relating to the Airport Authority of Washoe County; requiring police service for the authority to be provided by the sheriff of Washoe County; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 474, Statutes of Nevada 1977, at page 968, is

1-2 hereby amended by adding thereto a new section to be designated as

1-3 section 10.7, immediately following section 10.5, to read as follows:

1-4 Sec. 10.7. The board of trustees of the authority and the board

1-5 of county commissioners of Washoe County shall enter into an

1-6 interlocal agreement pursuant to the provisions of chapter 277 of

1-7 NRS that requires the sheriff of Washoe County to provide police

1-8 service to the authority. The interlocal agreement must not provide

1-9 for the payment of compensation for such service in an amount that

1-10 is greater than the value of the service provided.

1-11 Sec. 2. Section 10 of chapter 474, Statutes of Nevada 1977, as last

1-12 amended by chapter 359, Statutes of Nevada 1997, at page 1299, is hereby

1-13 amended to read as follows:

1-14 Sec. 10. The authority may do all things necessary to accomplish

1-15 the purposes of this act. The authority has perpetual succession and

1-16 may, by way of example and not of limitation:

1-17 1. Sue and be sued.

2-1 2. Plan, establish, acquire, construct, improve and operate one or

2-2 more airports within Washoe County.

2-3 3. Acquire real or personal property or any interest therein by

2-4 gift, lease or purchase for any of the purposes provided in this section,

2-5 including the elimination, prevention or marking of airport hazards.

2-6 4. Sell, lease or otherwise dispose of any real property in such

2-7 manner and upon such terms and conditions as the board deems

2-8 proper and in the best interests of the authority.

2-9 5. Acquire real property or any interest therein in areas most

2-10 affected by the noise of aircraft for the purpose of resale or lease

2-11 thereof, subject to restrictions limiting its use to industrial or other

2-12 purposes least affected by aircraft noise.

2-13 6. Enter into agreements with Washoe County and the cities of

2-14 Reno and Sparks to acquire, by lease, gift, purchase or otherwise, any

2-15 airport of such county or municipality and to operate that airport.

2-16 7. Exercise the power of eminent domain and dominant eminent

2-17 domain in the manner provided by law for the condemnation by a city

2-18 of private property for public use to take any property necessary to the

2-19 exercise of the powers granted, within Washoe County.

2-20 8. Apply directly to the proper federal, state, county and

2-21 municipal officials and agencies or to any other source, public or

2-22 private, for loans, grants, guarantees or other financial assistance in

2-23 aid of airports operated by it, and accept the same.

2-24 9. Study and recommend to the board of county commissioners of

2-25 Washoe County and the city councils of the cities of Reno and Sparks

2-26 zoning changes in the area of any airport operated by the authority

2-27 with respect to noise, height and aviation obstructions in order to

2-28 enable the authority to meet the requirements of any regulations of the

2-29 Federal Aviation Administration.

2-30 10. Control its airports with the right and duty to establish and

2-31 charge fees, rentals, rates and other charges, and collect revenues

2-32 therefrom, not inconsistent with the rights of the holders of its bonds,

2-33 and enter into agreements with carriers for the payment of landing

2-34 fees, rental rates and other charges.

2-35 11. Use in the performance of its functions the officers, agents,

2-36 employees, services, facilities, records and equipment of Washoe

2-37 County or the cities of Reno and Sparks, with the consent of the

2-38 respective county or municipality, and subject to such terms and

2-39 conditions as may be agreed upon.

2-40 12. Enter upon such lands, waters or premises as in the judgment

2-41 of the authority may be necessary for the purpose of making surveys,

2-42 soundings, borings and examinations to accomplish any purpose

2-43 authorized by this act. The authority is liable for actual damage done.

3-1 13. Provide its own fire protection [, police] and crash and rescue

3-2 service. [A person employed by the authority to provide police

3-3 service to the authority has the powers and must have the training

3-4 required of a law enforcement officer pursuant to Part 107 of Title 14

3-5 of the Code of Federal Regulations, as those provisions existed on

3-6 January 1, 1997. A person employed by the authority to provide

3-7 police service shall be deemed to be a peace officer for the purposes

3-8 of determining retirement benefits under the public employees’

3-9 retirement system.]

3-10 14. Contract with carriers with regard to landings and the

3-11 accommodations of the employees and passengers of those carriers.

3-12 15. Contract with persons or corporations to provide goods and

3-13 services for the use of the employees and passengers of the carriers

3-14 and the employees of the authority, as necessary or incidental to the

3-15 operation of the airports.

3-16 16. Hire and retain officers, agents and employees, including a

3-17 fiscal advisor, engineers, attorneys or other professional or specialized

3-18 personnel.

3-19 17. Adopt regulations governing vehicular traffic on the public

3-20 areas of its airports relating to but not limited to speed restrictions,

3-21 turning movements and other moving violations. It is unlawful for

3-22 any person to do any act forbidden or fail to perform any act required

3-23 in such regulations.

3-24 18. Adopt regulations governing parking, loading zones and

3-25 ground transportation operations on its airports and governing traffic

3-26 on restricted areas of its airports. The authority may establish a system

3-27 of:

3-28 (a) Administrative procedures for review of alleged violations of

3-29 such regulations; and

3-30 (b) Remedies for violations of such regulations, including the

3-31 imposition of administrative fines to be imposed upon and collected

3-32 from persons violating such regulations.

3-33 Sec. 3. 1. The board of trustees of the Airport Authority of Washoe

3-34 County and the board of county commissioners of Washoe County shall

3-35 enter into the interlocal agreement required by section 1 of this act,

3-36 effective January 1, 2000.

3-37 2. The Sheriff of Washoe County shall employ on January 1, 2000, to

3-38 provide police service to the Airport Authority of Washoe County, those

3-39 persons who are employed in that capacity by the authority on December

3-40 31, 1999, and who wish to continue in that capacity under the authority of

3-41 the Sheriff of Washoe County. The provisions of this subsection do not

3-42 prohibit the sheriff from terminating the employment of such a person after

3-43 January 1, 2000, for good cause shown.

4-1 Sec. 4. This act becomes effective upon passage and approval for the

4-2 purpose of entering into the interlocal agreement required by section 1 of

4-3 this act and on January 1, 2000, for all other purposes.
