CHAPTER........

AN ACT relating to public employment; exempting temporarily relatives of members of

certain town boards from prohibition against certain public employment; and

providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 281.210 is hereby amended to read as follows:

  1. 281.210 1. Except as otherwise provided in this section, it is
  1. unlawful for any person acting as a school trustee, state, township,
  1. municipal or county officer, or as an employing authority of the University
  1. and Community College System of Nevada, any school district or of the
  1. state, any town, city or county, or for any state or local board, agency or
  1. commission, elected or appointed, to employ in any capacity on behalf of
  1. the State of Nevada, or any county, township, municipality or school
  1. district thereof, or the University and Community College System of
  1. Nevada, any relative of such a person or of any member of such a board,
  1. agency or commission who is within the third degree of consanguinity or
  1. affinity.
  1. 2. This section does not apply:
  1. (a) To school districts, when the teacher or other school employee is not
  1. related to more than one of the trustees or person who is an employing
  1. authority by consanguinity or affinity and receives a unanimous vote of all
  1. members of the board of trustees and approval by the state department of
  1. education.
  1. (b) To school districts, when the teacher or other school employee has
  1. been employed by an abolished school district or educational district,
  1. which constitutes a part of the employing county school district, and the
  1. county school district for 4 years or more before April 1, 1957.
  1. (c) To the spouse of the warden of an institution or manager of a facility
  1. of the department of prisons.
  1. (d) To the spouse of the superintendent of the Caliente youth center.
  1. (e) To relatives of blind officers and employees of the bureau of services
  1. to the blind and visually impaired of the rehabilitation division of the
  1. department of employment, training and rehabilitation when those relatives
  1. are employed as automobile drivers for those officers and employees.
  1. (f) To relatives of a member of a town board of a town whose
  1. population is less than 300.
  1. 3. Nothing in this section:
  1. (a) Prevents any officer in this state, employed under a flat salary, from
  1. employing any suitable person to assist in any such employment, when the
  1. payment for the service is met out of the personal money of the officer.
  2. (b) Disqualifies any widow with a dependent as an employee of any
  1. officer or board in this state, or any of its counties, townships,
  1. municipalities or school districts.
  1. 4. A person employed contrary to the provisions of this section must
  1. not be compensated for the employment.
  1. 5. Any person violating any provisions of this section is guilty of a
  1. gross misdemeanor.

Sec. 2. This act becomes effective upon passage and approval and

expires by limitation on July 1, 2009.
