CHAPTER........
AN ACT relating to the Lake Tahoe Basin; authorizing Douglas County to enter into certain
contracts and agreements relating to the creation and operation of a nonprofit
organization to operate a transit system in the Lake Tahoe Basin; exempting
Douglas County from the Local Government Purchasing Act for the purposes of
entering into such contracts and agreements; and providing other matters properly
relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. The legislature hereby finds and declares that, because of
the unique and special conditions of the Lake Tahoe Basin, certain
exemptions are necessary to allow Douglas County to make arrangements
with and to enter into an agreement with other public and private entities
for the creation and operation of a nonprofit organization to own, operate
and maintain a coordinated transit system in the Lake Tahoe Basin. The
legislature further finds and declares that:
1. The Lake Tahoe Basin exhibits unique environmental and ecological
conditions that are irreplaceable.
2. The increasing development of the region is threatening the quality
of the water and air in the Lake Tahoe Basin.
3. The operation of a coordinated transit system in the Lake Tahoe
Basin will contribute to a reduction in the degradation of the quality of
water and air in the Basin.
4. Douglas County and other public and private entities in the Lake
Tahoe Basin desire to own, operate and maintain a coordinated transit
system through the creation and operation of a nonprofit organization.
5. The nonprofit organization will be created through a cooperative
agreement in which Douglas County will participate as a member.
6. A special act is necessary to provide participation in the cooperative
agreement creating the nonprofit organization, and that a general law
cannot be made applicable because of the need for cooperation between
public and private entities and the requirements for the preservation of the
quality of water and air that are unique to the Lake Tahoe Basin.
Sec. 2. 1. Douglas County may enter into contracts and agreements
with public and private entities for the purposes of creating, operating and
dissolving a nonprofit organization to own, operate and maintain a
coordinated transit system in the Lake Tahoe Basin.
2. Notwithstanding any other provision of law, Douglas County is
exempt from the provisions of chapter 332 of NRS for the purposes of
entering into contracts and agreements pursuant to subsection 1.
Sec. 3. This act becomes effective upon passage and approval.
