THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. 1. There is hereby appropriated from the state general1-2
fund to the Central Repository for Nevada Records of Criminal History of1-3
the Department of Motor Vehicles and Public Safety the sum of $200,0001-4
for use as provided in section 2 of this act.1-5
2. Any remaining balance of the appropriation made by subsection 11-6
must not be committed for expenditure after June 30, 2001, and reverts to1-7
the state general fund as soon as all payments of money committed have1-8
been made.1-9
Sec. 2. 1. The money appropriated by section 1 of this act must be1-10
set aside to cover costs directly related to requests for information relating1-11
to sexual offenses, as that term is defined in NRS 179A.065, from1-12
nonprofit agencies regarding volunteers who work directly with children or1-13
prospective volunteers who have applied to do so. Upon receipt of such a1-14
request for information, the Central Repository for Nevada Records of2-1
Criminal History of the Department of Motor Vehicles and Public Safety2-2
shall undertake a search for the information in the manner provided in2-3
NRS 179A.210 and Public Law 105-251, unless the request does not2-4
conform to the requirements of the Repository. The Repository shall,2-5
within the limits set forth in subsection 2, deduct from the money2-6
appropriated by section 1 of this act the costs of the search and shall2-7
maintain a record of the agency that requested the search and the amount2-8
of the related costs.2-9
2. The Repository shall process each such request in the order received2-10
and shall limit the amount of costs deducted from the appropriation made2-11
by section 1 of this act on behalf of an individual nonprofit agency to not2-12
more than $20,000 per year or the remaining balance of the money2-13
appropriated for this purpose, whichever is less. If an agency requests2-14
such a search, the costs of which will exceed the limit set forth in this2-15
section for the agency or after no money from the appropriation made by2-16
section 1 of this act remains, the Repository shall charge and collect a2-17
reasonable fee for undertaking the search requested.2-18
Sec. 3. 1. This act becomes effective upon passage and approval.2-19
2. Section 2 of this act expires by limitation on June 30, 2001.~
