AN ACT relating to county government; increasing the number of members on the board of county commissioners in certain counties; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 244.016 is hereby amended to read as follows:

1-2 244.016 1. In each county whose population is 400,000 or more, the

1-3 board of county commissioners consists of [seven] 13 members. Each

1-4 member must be a resident of, and elected by the registered voters of, a

1-5 county commissioner election district established pursuant to this chapter.

1-6 2. The board of county commissioners shall establish [seven] 13

1-7 county commissioner election districts which must be as nearly equal in

1-8 population as practicable, and each of which must be composed entirely of

1-9 contiguous territory and be as compact as possible.

1-10 Sec. 2. 1. On or before January 1, 2002, in any county whose

1-11 population is 400,000 or more, the board of county commissioners shall,

1-12 pursuant to NRS 244.018, establish new county commissioner election

1-13 districts by ordinance and provide for the election of the new members

1-14 added to the board pursuant to the amendatory provisions of section 1 of

1-15 this act for initial terms of 2 years and 4 years so that the numbers of

1-16 county commissioners to be elected at each general election thereafter will

1-17 be as nearly equal as possible.

2-1 2. The new election districts established pursuant to subsection 1 for

2-2 purposes of nominating candidates for and electing county commissioners

2-3 at the general election in 2002 must be based on the population as

2-4 determined by the 2000 national decennial census conducted by the Bureau

2-5 of the Census of the United States Department of Commerce pursuant to

2-6 section 2 of article I of the Constitution of the United States and reported

2-7 by the Secretary of Commerce to the governor pursuant to 13 U.S.C. §

2-8 141(c).

2-9 Sec. 3. The provisions of subsection 1 of NRS 354.599 do not apply

2-10 to any additional expenses of a local government that are related to the

2-11 provisions of this act.

2-12 Sec. 4. This act becomes effective on July 1, 2001, for the purposes of

2-13 establishing the boundaries of the new county commissioner election

2-14 districts pursuant to the provisions of this act and for nominating

2-15 candidates for and electing county commissioners at the general election in

2-16 2002. For all other purposes, this act becomes effective on January 6,

2-17 2003.
