AN ACT relating to motor vehicles; providing for the issuance of special license plates for the support of the preservation and restoration of the natural environment of the Mount Charleston Wilderness of the Toiyabe National Forest; imposing a fee for the issuance or renewal of such license plates; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in this subsection, the department, in

1-4 cooperation with the division of state lands of the state department of

1-5 conservation and natural resources, shall design, prepare and issue

1-6 license plates for the support of the preservation and restoration of the

1-7 natural environment of the Mount Charleston Wilderness of the Toiyabe

1-8 National Forest using any colors that the department deems appropriate.

1-9 The design of the license plates must include a depiction of Mount

1-10 Charleston and its surrounding area. The department shall not design,

1-11 prepare or issue the license plates unless it receives at least 250

1-12 applications for the issuance of those plates.

1-13 2. If the department receives at least 250 applications for the issuance

1-14 of license plates for the support of the preservation and restoration of the

1-15 natural environment of the Mount Charleston Wilderness, the department

1-16 shall issue those plates for a passenger car or light commercial vehicle

2-1 upon application by a person who is entitled to license plates pursuant to

2-2 NRS 482.265 and who otherwise complies with the requirements for

2-3 registration and licensing pursuant to this chapter. A person may request

2-4 that personalized prestige license plates issued pursuant to NRS 482.3667

2-5 be combined with license plates for the support of the preservation and

2-6 restoration of the natural environment of the Mount Charleston

2-7 Wilderness if that person pays the fees for the personalized prestige

2-8 license plates in addition to the fees for the license plates for the support

2-9 of the preservation and restoration of the natural environment of the

2-10 Mount Charleston Wilderness pursuant to subsections 3 and 4.

2-11 3. The fee for license plates for the support of the preservation and

2-12 restoration of the natural environment of the Mount Charleston

2-13 Wilderness is $35, in addition to all other applicable registration and

2-14 license fees and motor vehicle privilege taxes. The license plates are

2-15 renewable upon the payment of $10.

2-16 4. In addition to all fees for the license, registration and privilege

2-17 taxes, a person who requests a set of license plates for the support of the

2-18 preservation and restoration of the natural environment of the Mount

2-19 Charleston Wilderness must pay for the initial issuance of the plates an

2-20 additional fee of $25 and for each renewal of the plates an additional fee

2-21 of $20 to finance projects for the preservation and restoration of the

2-22 natural environment of the Mount Charleston Wilderness.

2-23 5. The department shall deposit the fees collected pursuant to

2-24 subsection 4 with the state treasurer for credit to the account for license

2-25 plates for the support of the preservation and restoration of the natural

2-26 environment of the Mount Charleston Wilderness of the Toiyabe National

2-27 Forest created pursuant to section 3 of this act.

2-28 6. If, during a registration year, the holder of license plates issued

2-29 pursuant to the provisions of this section disposes of the vehicle to which

2-30 the plates are affixed, he may retain the plates and:

2-31 (a) Affix them to another vehicle that meets the requirements of this

2-32 section if the transfer and registration fees are paid as set out in this

2-33 chapter; or

2-34 (b) Within 30 days after removing the plates from the vehicle, return

2-35 them to the department.

2-36 Sec. 2. NRS 482.216 is hereby amended to read as follows:

2-37 482.216 1. Upon the request of a new vehicle dealer, the department

2-38 may authorize the new vehicle dealer to:

2-39 (a) Accept applications for the registration of the new motor vehicles he

2-40 sells and the related fees and taxes;

2-41 (b) Issue certificates of registration to applicants who satisfy the

2-42 requirements of this chapter; and

3-1 (c) Accept applications for the transfer of registration pursuant to NRS

3-2 482.399 if the applicant purchased from the new vehicle dealer a new

3-3 vehicle to which the registration is to be transferred.

3-4 2. A new vehicle dealer who is authorized to issue certificates of

3-5 registration pursuant to subsection 1 shall:

3-6 (a) Transmit the applications he receives to the department within the

3-7 period prescribed by the department;

3-8 (b) Transmit the fees he collects from the applicants and properly

3-9 account for them within the period prescribed by the department;

3-10 (c) Comply with the regulations adopted pursuant to subsection 4; and

3-11 (d) Bear any cost of equipment which is necessary to issue certificates of

3-12 registration, including any computer hardware or software.

3-13 3. A new vehicle dealer who is authorized to issue certificates of

3-14 registration pursuant to subsection 1 shall not:

3-15 (a) Charge any additional fee for the performance of those services;

3-16 (b) Receive compensation from the department for the performance of

3-17 those services;

3-18 (c) Accept applications for the renewal of registration of a motor

3-19 vehicle; or

3-20 (d) Accept an application for the registration of a motor vehicle if the

3-21 applicant wishes to:

3-22 (1) Obtain special license plates pursuant to NRS 482.3667 to

3-23 482.3825, inclusive [;] , and section 1 of this act; or

3-24 (2) Claim the exemption from the vehicle privilege tax provided

3-25 pursuant to NRS 361.1565 to veterans and their relations.

3-26 4. The director shall adopt such regulations as are necessary to carry

3-27 out the provisions of this section. The regulations adopted pursuant to this

3-28 subsection must provide for:

3-29 (a) The expedient and secure issuance of license plates and decals by the

3-30 department; and

3-31 (b) The withdrawal of the authority granted to a new vehicle dealer

3-32 pursuant to subsection 1 if that dealer fails to comply with the regulations

3-33 adopted by the department.

3-34 Sec. 3. Chapter 321 of NRS is hereby amended by adding thereto a

3-35 new section to read as follows:

3-36 1. The account for license plates for the support of the preservation

3-37 and restoration of the natural environment of the Mount Charleston

3-38 Wilderness of the Toiyabe National Forest is hereby created in the state

3-39 general fund. The administrator of the division of state lands of the state

3-40 department of conservation and natural resources shall administer the

3-41 account.

3-42 2. The money in the account does not lapse to the state general fund

3-43 at the end of a fiscal year. The interest and income earned on the money

4-1 in the account, after deducting any applicable charges, must be credited

4-2 to the account.

4-3 3. The money in the account must be used only for the support of

4-4 programs for the preservation and restoration of the natural environment

4-5 of the Mount Charleston Wilderness and must not be used to replace or

4-6 supplant money available from other sources. The administrator may

4-7 provide grants from the account to other public agencies to carry out the

4-8 provisions of this section.

4-9 Sec. 4. The amendatory provisions of this act expire by limitation on

4-10 October 1, 2003, if on that date the department of motor vehicles and public

4-11 safety has received fewer than 250 applications for the issuance of a license

4-12 plate pursuant to section 1 of this act.
