AN ACT relating to the board of wildlife commissioners; requiring nomination by a county advisory board to manage wildlife before certain persons may be appointed to the commission; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 501.171 is hereby amended to read as follows:

1-2 501.171 1. A [county advisory board to manage wildlife] board shall

1-3 submit written nominations for appointments to the commission upon the

1-4 request of the governor and may submit nominations at any other time.

1-5 2. After consideration of the written nominations submitted by a

1-6 [county advisory board to manage wildlife] board and any additional

1-7 candidates for appointment to the commission, the governor shall appoint

1-8 to the commission:

1-9 (a) One member who is actively engaged in the conservation of

1-10 wildlife;

1-11 (b) One member who is actively engaged in farming;

1-12 (c) One member who is actively engaged in ranching; and

1-13 (d) One member who represents the interests of the general public . [;

1-15 (e) Five]

1-16 3. The governor shall appoint five additional members who , during

1-17 at least 3 of the 4 years immediately preceding their appointment , held a

1-18 resident license to fish or hunt, or both, in [Nevada.

2-1 3.] this state and who were nominated pursuant to subsection 1.

2-2 4. The governor shall not appoint to the commission any person who

2-3 has been convicted of:

2-4 (a) A gross misdemeanor for a violation of NRS 501.376, 502.060 or

2-5 504.395; or

2-6 (b) Two or more violations of the provisions of chapters 501 to 504,

2-7 inclusive, of NRS,

2-8 during the previous 10 years.

2-9 [4.] 5. Not more than three members may be from the same county

2-10 whose population is 400,000 or more, not more than two members may be

2-11 from the same county whose population is 100,000 or more but less than

2-12 400,000, and not more than one member may be from the same county

2-13 whose population is less than 100,000.

2-14 [5.] 6. The commission shall annually select a chairman and a vice

2-15 chairman from among its members. A person shall not serve more than two

2-16 consecutive terms as chairman.

2-17 Sec. 2. Upon the expiration of the term of a member of the board of

2-18 wildlife commissioners who was appointed pursuant to paragraph (e) of

2-19 subsection 2 of NRS 501.171, as that section existed before the effective

2-20 date of this act, the governor shall appoint a member to the board of

2-21 wildlife commissioners who was nominated by a county advisory board to

2-22 manage wildlife in accordance with the amendatory provisions of section 1

2-23 of this act.

2-24 Sec. 3. This act becomes effective upon passage and approval.
