AN ACT relating to the transportation of pupils; revising provisions governing the authority of

the boards of trustees of school districts to purchase tickets for the transportation of

pupils on public buses; authorizing fully regulated carriers to provide reduced rates to

the boards of trustees of school districts for the transportation of pupils; and providing

other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 392.330 is hereby amended to read as follows:

  1. 392.330 1. In addition to the purposes authorized by NRS 392.320, a
  1. board of trustees may use transportation funds of the school district for:
  1. (a) Arranging and paying for transportation, in accordance with subsection
  1. 2, by motor vehicles or otherwise, by contract or such other arrangement as
  1. the board of trustees finds most economical, expedient and feasible and for
  1. the best interests of the school district.

(b) Purchasing tickets at reduced rates for the transportation of pupils,

including, without limitation, homeless pupils, on public buses for use by

pupils enrolled in middle school, junior high school and high school to

travel to and from school.

  1. 2. [Such transportation] Transportation may be arranged and contracted
  1. for by a board of trustees with:
  1. (a) Any railroad company holding a certificate of public convenience and
  1. necessity issued by the public utilities commission of Nevada or bus company
  1. or other licensed common carrier holding a certificate of public convenience
  1. and necessity issued by the transportation services authority.
  1. (b) The owners and operators of private automobiles or other private motor
  1. vehicles, including parents of pupils who attend school and are entitled to
  1. transportation. When required by the board of trustees, every such private
  1. automobile or other private motor vehicle regularly transporting pupils must
  1. be insured in the amount required by regulation of the state board against the
  1. loss and damage described in subsection 2 of NRS 392.320.

Sec. 2. NRS 706.351 is hereby amended to read as follows:

  1. 706.351 1. It is unlawful for:
  1. (a) A fully regulated carrier to furnish any pass, frank, free or reduced rates
  1. for transportation to any state, city, district, county or municipal officer of this
  1. state or to any person other than those specifically enumerated in this section.
  1. (b) Any person other than those specifically enumerated in this section to
  1. receive any pass, frank, free or reduced rates for transportation.
  1. 2. This section does not prevent the carriage, storage or hauling free or at
  1. reduced rates of passengers or property for charitable organizations or
  1. purposes for the United States, the State of Nevada or any political
  1. subdivision thereof.
  1. 3. This chapter does not prohibit a fully regulated common carrier from
  1. giving free or reduced rates for transportation of persons to:
  1. (a) Its own officers, commission agents or employees, or members of any
  1. profession licensed under Title 54 of NRS retained by it, and members of their
  1. families.
  1. (b) Inmates of hospitals or charitable institutions and persons over 60 years
  1. of age.
  1. (c) Persons who are physically handicapped or mentally handicapped and
  1. who present a written statement from a physician to that effect.
  1. (d) Persons injured in accidents or wrecks and physicians and nurses
  1. attending such persons.
  1. (e) Persons providing relief in cases of common disaster.
  1. (f) Attendants of livestock or other property requiring the care of an
  1. attendant, who must be given return passage to the place of shipment, if there
  1. is no discrimination among shippers of a similar class.
  1. (g) Officers, agents, employees or members of any profession licensed
  1. under Title 54 of NRS, together with members of their families, who are
  1. employed by or affiliated with other common carriers, if there is an
  1. interchange of free or reduced rates for transportation.
  1. (h) Indigent, destitute or homeless persons when under the care or
  1. responsibility of charitable societies, institutions or hospitals, together with the
  1. necessary agents employed in such transportation.
  1. (i) Students of institutions of learning [.] , including, without limitation,
  1. homeless students, whether the free or reduced rate is given directly to a
  1. student or to the board of trustees of a school district on behalf of a student.
  1. (j) Groups of persons participating in a tour for a purpose other than
  1. transportation.
  1. 4. This section does not prohibit common motor carriers from giving free
  1. or reduced rates for the transportation of property of:
  1. (a) Their officers, commission agents or employees, or members of any
  1. profession licensed under Title 54 of NRS retained by them, or pensioned or
  1. disabled former employees, together with that of their dependents.
  1. (b) Witnesses attending any legal investigations in which such carriers are
  1. interested.
  1. (c) Persons providing relief in cases of common disaster.
  1. (d) Charitable organizations providing food and items for personal hygiene
  1. to needy persons or to other charitable organizations within this state.
  1. 5. This section does not prohibit the authority from establishing reduced
  1. rates, fares or charges for specified routes or schedules of any common motor
  1. carrier providing transit service if the reduced rates, fares or charges are
  1. determined by the authority to be in the public interest.
  1. 6. Only fully regulated common carriers may provide free or reduced
  1. rates for the transportation of passengers or household goods, pursuant to the
  1. provisions of this section.
  1. 7. As used in this section, "employees" includes:
  1. (a) Furloughed, pensioned and superannuated employees.
  1. (b) Persons who have become disabled or infirm in the service of such
  1. carriers.
  1. (c) Persons who are traveling to enter the service of such a carrier.

Sec. 3. This act becomes effective on July 1, 1999.
