CHAPTER........

AN ACT relating to peace officers; prohibiting false or fraudulent complaints against a peace

officer; requiring each agency that employs peace officers to establish a written

procedure for investigating complaints against peace officers; providing a penalty;

and providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 199 of NRS is hereby amended by adding thereto a

new section to read as follows:

1. A person who knowingly files a false or fraudulent written

complaint or allegation of misconduct against a peace officer for

conduct in the course and scope of his employment is guilty of a

misdemeanor.

2. As used in this section, "peace officer" has the meaning ascribed

to it in NRS 289.010.

Sec. 2. Chapter 289 of NRS is hereby amended by adding thereto a

new section to read as follows:

Each agency in this state that employs peace officers shall:

1. Establish written procedures for investigating any complaint or

allegation of misconduct made or filed against a peace officer employed

by the agency; and

2. Make copies of the written procedures established pursuant to

subsection 1 available to the public.

Sec. 3. The amendatory provisions of this act do not apply to offenses

that were committed before October 1, 1999.
