AN ACT relating to education; making various changes concerning the discipline of pupils for carrying or possessing certain electronic devices for paging or communicating on school grounds; providing a civil penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 392.500 is hereby amended to read as follows:

1-2 392.500 1. [Except as otherwise provided in subsection 2, it is

1-3 unlawful for] The board of trustees of each school district shall adopt and

1-4 enforce measures for disciplining a pupil in kindergarten or grades 1 to

1-5 12, inclusive, who, while on school grounds, [to carry or possess] carries

1-6 or possesses a beeper, portable telephone or any other similar electronic

1-7 device designed to page or contact a person [.

1-8 2. A pupil may carry or possess a beeper, portable telephone or other

1-9 similar device on school grounds if] , unless he is expressly authorized in

1-10 writing to do so by the school administrator.

1-11 2. The measures for disciplining a pupil pursuant to subsection 1

1-12 must include, without limitation:

1-13 (a) Imposing a civil penalty of:

1-14 (1) For the first offense, $25;

1-15 (2) For the second offense, $50;

2-1 (3) For the third offense, $100; and

2-2 (4) For the fourth and any subsequent offense, $200.

2-3 (b) Requiring the pupil to forfeit the device.

2-4 3. As used in this section, "beeper" means a portable electronic device

2-5 which is used to page the person carrying it by emitting an audible or a

2-6 vibrating signal when the device receives a special radio signal.

2-7 Sec. 2. This act becomes effective on July 1, 1999.
