AN ACT relating to railroads; providing that no railroad train may operate in this state unless it has a crew of at least two competent employees; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 705 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in this section, no railroad train may

1-4 be operated in this state unless the train has a crew of at least two

1-5 competent employees. At least one of the employees on the crew must be a

1-6 certified engineer.

1-7 2. The public utilities commission of Nevada may grant an exception

1-8 to subsection 1 if the commission determines that the exception will not

1-9 endanger the life or property of any person.

1-10 3. The provisions of this section do not apply to the extent that they

1-11 are contrary to or inconsistent with a regulation or order of the Federal

1-12 Railroad Administration of the United States Department of

1-13 Transportation.

1-14 4. As used in this section, "certified engineer" means a person

1-15 certified in accordance with Part 240 of Title 49 of the Code of Federal

1-16 Regulations as a train service engineer, locomotive servicing engineer or

1-17 student engineer.
