THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 705 of NRS is hereby amended by adding thereto a1-2
new section to read as follows:1-3
1. Except as otherwise provided in this section, no railroad train may1-4
be operated in this state unless the train has a crew of at least two1-5
competent employees. At least one of the employees on the crew must be a1-6
certified engineer.1-7
2. The public utilities commission of Nevada may grant an exception1-8
to subsection 1 if the commission determines that the exception will not1-9
endanger the life or property of any person.1-10
3. The provisions of this section do not apply to the extent that they1-11
are contrary to or inconsistent with a regulation or order of the Federal1-12
Railroad Administration of the United States Department of1-13
Transportation.1-14
4. As used in this section, "certified engineer" means a person1-15
certified in accordance with Part 240 of Title 49 of the Code of Federal1-16
Regulations as a train service engineer, locomotive servicing engineer or1-17
student engineer.
