AN ACT relating to agricultural extension programs; expanding the subjects included in agricultural extension programs; making an appropriation to the agricultural extension department of the public service division of the University and Community College System of Nevada for the abatement of tall white top; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 549.010 is hereby amended to read as follows:

1-2 549.010 To provide for continued [extension work in agriculture,

1-3 home economics and rural welfare] educational, research, outreach and

1-4 service programs pertaining to agriculture, community development,

1-5 health and nutrition, horticulture, personal and family development, and

1-6 natural resources in the rural and urban communities in the State of

1-7 Nevada, the director of the agricultural extension department of the public

1-8 service division of the University and Community College System of

1-9 Nevada and the boards of county commissioners of any or all of the

1-10 respective counties of the State of Nevada may enter into cooperative

1-11 agreements and activities subject to the provisions of this chapter.

2-1 Sec. 2. NRS 549.020 is hereby amended to read as follows:

2-2 549.020 1. The director of the agricultural extension department of

2-3 the public service division of the University and Community College

2-4 System of Nevada shall prepare and submit to the board of county

2-5 commissioners, for each county participating, an annual financial budget

2-6 covering the county, state and federal funds cooperating in the cost of

2-7 [cooperative extension work in agriculture and home economics.]

2-8 educational, research, outreach and service programs pertaining to

2-9 agriculture, community development, health and nutrition, horticulture,

2-10 personal and family development, and natural resources in the rural and

2-11 urban communities in the State of Nevada.

2-12 2. The budget must be adopted by the board of county commissioners

2-13 and certified as a part of the annual county budget, and the county tax levy

2-14 provided for agricultural extension work in the annual county budget must

2-15 include a levy of not less than 1 cent on each $100 of taxable property. If

2-16 the proceeds of the county tax levy of 1 cent are insufficient to meet the

2-17 county’s share of the cooperative agricultural extension work, as provided

2-18 in the combined annual financial budget, the board of county

2-19 commissioners may, by unanimous vote, levy an additional tax so that the

2-20 total in no instance exceeds 5 cents on each $100 of the county tax rate.

2-21 3. The proceeds of such a tax must be placed in the agricultural

2-22 extension fund in each county treasury and must be paid out on claims

2-23 drawn by the agricultural extension agent of the county as designated by

2-24 the director of the agricultural extension department of the public service

2-25 division of the University and Community College System of Nevada,

2-26 when approved by the director and countersigned by the treasurer of the

2-27 University and Community College System of Nevada.

2-28 4. A record of all such claims approved and paid, segregated by

2-29 counties, must be kept by the treasurer of the University and Community

2-30 College System of Nevada. The cost of maintaining the record must be

2-31 paid from state funds provided for by this chapter.

2-32 5. The state’s cooperative share of the cost of such agricultural

2-33 extension work, as entered in the budget described in this section, must not

2-34 be more than a sum equal to the proceeds of 1 cent of such county tax rate;

2-35 but when the proceeds of a 1-cent tax rate are insufficient to carry out the

2-36 provisions of the budget previously adopted, the director of the agricultural

2-37 extension department of the public service division of the University and

2-38 Community College System of Nevada is authorized to supplement the

2-39 state’s cooperative share from the funds as may be made available in the

2-40 public service division fund of the University and Community College

2-41 System of Nevada.

2-42 Sec. 3. 1. There is hereby appropriated from the state general fund

2-43 to the agricultural extension department of the public service division of

3-1 the University and Community College System of Nevada the sum of

3-2 $125,000 for the abatement of tall white top.

3-3 2. Any remaining balance of the appropriation made by subsection 1

3-4 must not be committed for expenditure after June 30, 2001, and reverts to

3-5 the state general fund as soon as all payments of money committed have

3-6 been made.

3-7 Sec. 4. This act becomes effective upon passage and approval.
