THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 425.430 is hereby amended to read as follows: 425.430 1. Except as otherwise provided in subsection 2 of this1-3
section and in subsection 3 of NRS 425.410, any money recovered by the1-4
enforcing authority under this chapter must be distributed pursuant to1-5
regulations adopted by the division which must not disqualify this state for1-6
federal grants under Title IV of the Social Security Act ,1-7
601 et seq.1-8
2. The money assigned to the division pursuant to NRS 425.350 that1-9
is collected by the enforcing authority each fiscal year and retained as1-10
reimbursement to the state for the provision of public assistance must,1-11
after deducting:1-12
(a) Any payments required by federal law or as a condition to the1-13
receipt of federal money; and2-1
(b) The administrative expenses of the state to carry out the program,2-2
be deposited in the account to improve the quality of services for child2-3
care created pursuant to section 3 of this act.2-4
Sec. 2. Chapter 432A of NRS is hereby amended by adding thereto2-5
the provisions set forth as sections 3 and 4 of this act.2-6
Sec. 3. 1. The account to improve the quality of services for child2-7
care is hereby created in the state general fund.2-8
2. The director shall administer the account and may accept gifts and2-9
grants of money from any source for deposit in the account. The director2-10
may expend not more than 50 percent of the amount deposited annually2-11
in the account to carry out section 4 of this act.2-12
3. The interest and income earned on the money in the account, after2-13
deducting any applicable charges, must be credited to the account. The2-14
money in the account does not lapse to the state general fund at the end2-15
of a fiscal year. All claims against the account must be paid as other2-16
claims against the state are paid.2-17
Sec. 4. The director shall:2-18
1. Establish a program to assist in:2-19
(a) Improving the education and training of providers of child care in2-20
this state;2-21
(b) The certification of providers of child care in this state by the2-22
National Association for the Education of Young Children or its2-23
successor organization;2-24
(c) Increasing the ratio of the number of persons providing child care2-25
in this state to the number of children receiving child care in this state;2-26
(d) Increasing the remuneration of providers of child care in this2-27
state; and2-28
(e) Decreasing the turnover rate among persons employed to provide2-29
child care in this state.2-30
2. Prepare and advertise a request for proposals by independent2-31
contractors to assist in carrying out the program established pursuant to2-32
subsection 1. Any contract awarded to such a contractor must be2-33
awarded by competitive selection and require the contractor to provide2-34
funding to carry out the program in an amount that is not less than the2-35
amount of money provided to the contractor by the director.2-36
Sec. 5. The director of the department of human resources:2-37
1. Shall use his best efforts to ensure that the program established2-38
pursuant to section 4 of this act is achieving successful results before2-39
January 1, 2001.2-40
2. Shall:2-41
(a) Cause an independent study to be conducted to determine:2-42
(1) The effect of the program established pursuant to section 4 of this2-43
act on:3-1
(I) The average amount of education and training obtained by3-2
providers of child care in this state;3-3
(II) The number of providers of child care in this state who have3-4
obtained or are in the process of obtaining certification from the National3-5
Association for the Education of Young Children or its successor3-6
organization;3-7
(III) The ratio of the number of persons providing child care in this3-8
state to the number of children receiving child care in this state;3-9
(IV) The average amount of remuneration received by providers of3-10
child care in this state; and3-11
(V) The turnover rate among persons employed to provide child3-12
care in this state; and3-13
(2) The amount, origin and purpose of funding provided to carry out3-14
the program established pursuant to section 4 of this act, from sources3-15
other than the account to improve the quality of services for child care3-16
created pursuant to section 3 of this act; and3-17
(b) On or before January 15, 2001, submit the findings of the study to3-18
the director of the legislative counsel bureau for transmittal to the 71st3-19
session of the Nevada Legislature.3-20
3. May expend money from the account to improve the quality of3-21
services for child care created pursuant to section 3 of this act to carry out3-22
the provisions of subsection 2.3-23
Sec. 6. This act becomes effective on June 30, 1999.~
