AN ACT relating to public schools; requiring the superintendent of public instruction to provide certain information concerning statutes and regulations affecting public schools and pupils to the boards of trustees of school districts; requiring the boards of trustees to provide similar information to parents and educational personnel; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 385.210 is hereby amended to read as follows:

1-2 385.210 1. The superintendent of public instruction shall prescribe a

1-3 convenient form of school register for the purpose of securing accurate

1-4 returns from the teachers of public schools.

1-5 2. The superintendent shall prepare pamphlet copies of the [school

1-6 law,] codified statutes relating to schools, and shall transmit a copy to each

1-7 school, school trustee [,] and other school officer in [the state. When] this

1-8 state. If additions or amendments are made to [the school law, he] these

1-9 codified statutes, the superintendent shall have [them] the additions or

1-10 amendments printed and transmitted immediately thereafter. Each

1-11 pamphlet [shall] must be marked "State property—to be turned over to

1-12 your successor in office." Each school shall maintain a copy of the

1-13 pamphlet with any additions or amendments in the school library for

1-14 public reference.

2-1 3. In addition to the requirements set forth in subsection 2, the

2-2 superintendent shall provide to the board of trustees of each school

2-3 district a memorandum that describes each statute newly enacted by the

2-4 legislature and each regulation newly adopted by the department or the

2-5 state board which affects the public schools in this state and the pupils

2-6 who are enrolled in the public schools in this state. Such a memorandum

2-7 must include, without limitation, a concise plan for carrying out each

2-8 statute and regulation described in the memorandum, the date on which

2-9 the statute or regulation becomes effective and the date by which it must

2-10 be carried into effect by a school district or public school. Each such

2-11 memorandum, must be made available not later than 30 days after the

2-12 statute or regulation described in that memorandum becomes effective.

2-13 Not later than 30 days after receipt of each such memorandum from the

2-14 superintendent, the board of trustees of a school district shall provide

2-15 written notice of the information contained in the memorandum to each

2-16 parent or legal guardian of a pupil who is enrolled in a public school

2-17 within the school district and all teachers, administrators and other

2-18 educational personnel who are employed by the board of trustees. If the

2-19 parent or legal guardian of a pupil cannot understand English, the notice

2-20 must be provided in a language that the parent or legal guardian can

2-21 understand or, if necessary, provided orally to the parent or legal

2-22 guardian in a language that he can understand.

2-23 4. The superintendent shall, if directed by the state board, prepare and

2-24 publish a bulletin as the official publication of the department.

2-25 Sec. 2. NRS 386.360 is hereby amended to read as follows:

2-26 386.360 1. The board of trustees of a school district shall ensure

2-27 that each parent or legal guardian of a pupil who is enrolled in a public

2-28 school within the school district and all teachers, administrators and

2-29 other educational personnel who are employed by the board of trustees

2-30 receive information concerning the statutes and regulations affecting the

2-31 system of public schools in this state and the pupils who are enrolled in

2-32 the public schools in this state in accordance with the provisions of

2-33 subsection 3 of NRS 385.210.

2-34 2. Each board of trustees may prescribe and enforce rules, not

2-35 inconsistent with law or rules prescribed by the state board , [of education,]

2-36 for its own government and the government of public schools under its

2-37 charge.

2-38 [2.] 3. Each board of trustees shall prescribe rules for the granting of

2-39 permission to carry or possess a weapon pursuant to NRS 202.265.

3-1 Sec. 3. The superintendent of public instruction and the board of

3-2 trustees of each school district shall provide information on statutes and

3-3 regulations in accordance with the amendatory provisions of subsection 3

3-4 of section 1 of this act for all statutes and regulations that are effective on

3-5 or after July 1, 1999.

3-6 Sec. 4. This act becomes effective on July 1, 1999.
