AN ACT relating to law enforcement; requiring the boards of trustees of certain school districts to contract with metropolitan police departments or other local law enforcement agencies for police services; requiring the creation of a school police unit within each metropolitan police department; directing the transfer of certain employees; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 391.100 is hereby amended to read as follows:

1-2 391.100 1. The board of trustees of a school district may employ a

1-3 superintendent of schools, teachers and all other necessary employees.

1-4 2. The board of trustees of a school district:

1-5 (a) May employ teacher aides and other auxiliary, nonprofessional

1-6 personnel to assist licensed personnel in the instruction or supervision of

1-7 children, either in the classroom or at any other place in the school or on

1-8 the grounds thereof; and

1-9 (b) Shall establish policies governing the duties and performance of

1-10 teacher aides.

1-11 3. Each applicant for employment pursuant to this section, except a

1-12 teacher or other person licensed by the superintendent of public

1-13 instruction, must, as a condition to employment, submit to the school

1-14 district a full set of his fingerprints and written permission authorizing the

1-15 school district to forward the fingerprints to the Federal Bureau of

1-16 Investigation and the central repository for Nevada records of criminal

1-17 history for their reports on the criminal history of the applicant.

2-1 4. [The] Except as otherwise provided in subsection 5, the board of

2-2 trustees of a school district may employ or appoint persons to serve as

2-3 school police officers. In addition, persons who provide police services

2-4 pursuant to subsection 5 shall be deemed school police officers.

2-5 5. The board of trustees of a school district in a county that has a

2-6 metropolitan police department created pursuant to chapter 280 of NRS,

2-7 shall contract with the metropolitan police department for the provision

2-8 and supervision of police services in the public schools within the

2-9 jurisdiction of the metropolitan police department and on property

2-10 therein that is owned by the school district. The board of trustees of such

2-11 a school district shall, if applicable, cooperate with appropriate local law

2-12 enforcement agencies within the school district for the provision and

2-13 supervision of police services in the public schools within the school

2-14 district and on property owned by the school district but outside the

2-15 jurisdiction of the metropolitan police department.

2-16 Sec. 2. Chapter 280 of NRS is hereby amended by adding thereto a

2-17 new section to read as follows:

2-18 1. The department shall enter into a contract with the board of

2-19 trustees of the school district located in the county served by the

2-20 department for the provision and supervision of police services in the

2-21 public schools within the school district and on property owned by the

2-22 school district. The department shall create a separate unit designated as

2-23 the school police unit for this purpose.

2-24 2. The department may establish different qualifications and training

2-25 requirements for officers assigned to the school police unit than those

2-26 generally applicable to officers of the department.

2-27 Sec. 3. NRS 280.320 is hereby amended to read as follows:

2-28 280.320 1. A department is a local government employer for the

2-29 purpose of the Local Government Employee-Management Relations Act

2-30 and a public employer for the purpose of the Public Employees’

2-31 Retirement Act.

2-32 2. In negotiations arising under the provisions of chapter 288 of NRS:

2-33 (a) The committee or two or more persons designated by it; and

2-34 (b) The sheriff or a person designated by him,

2-35 shall represent the department.

2-36 3. In negotiations arising under the provisions of chapter 288 of

2-37 NRS, the school police unit must be considered a separate bargaining

2-38 unit.

2-39 Sec. 4. On or before September 1, 1999, the board of trustees of a

2-40 school district in a county that has a metropolitan police department

2-41 created pursuant to chapter 280 of NRS shall transfer each school police

2-42 officer employed by the school district to the metropolitan police

2-43 department. Upon such a transfer, the metropolitan police department shall

3-1 employ each such transferred employee and assign each such transferred

3-2 employee to the school police unit within the department. The

3-3 compensation and employment benefits provided to each employee so

3-4 transferred must remain at least equal to that provided to him by the school

3-5 district at the time of the transfer.

3-6 Sec. 5. This act becomes effective on July 1, 1999.
