THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 391.100 is hereby amended to read as follows: 391.100 1. The board of trustees of a school district may employ a1-3
superintendent of schools, teachers and all other necessary employees.1-4
2. The board of trustees of a school district:1-5
(a) May employ teacher aides and other auxiliary, nonprofessional1-6
personnel to assist licensed personnel in the instruction or supervision of1-7
children, either in the classroom or at any other place in the school or on1-8
the grounds thereof; and1-9
(b) Shall establish policies governing the duties and performance of1-10
teacher aides.1-11
3. Each applicant for employment pursuant to this section, except a1-12
teacher or other person licensed by the superintendent of public1-13
instruction, must, as a condition to employment, submit to the school1-14
district a full set of his fingerprints and written permission authorizing the1-15
school district to forward the fingerprints to the Federal Bureau of1-16
Investigation and the central repository for Nevada records of criminal1-17
history for their reports on the criminal history of the applicant.2-1

trustees of a school district may employ or appoint persons to serve as2-3
school police officers. In addition, persons who provide police services2-4
pursuant to subsection 5 shall be deemed school police officers.2-5
5. The board of trustees of a school district in a county that has a2-6
metropolitan police department created pursuant to chapter 280 of NRS,2-7
shall contract with the metropolitan police department for the provision2-8
and supervision of police services in the public schools within the2-9
jurisdiction of the metropolitan police department and on property2-10
therein that is owned by the school district. The board of trustees of such2-11
a school district shall, if applicable, cooperate with appropriate local law2-12
enforcement agencies within the school district for the provision and2-13
supervision of police services in the public schools within the school2-14
district and on property owned by the school district but outside the2-15
jurisdiction of the metropolitan police department.2-16
Sec. 2. Chapter 280 of NRS is hereby amended by adding thereto a2-17
new section to read as follows:2-18
1. The department shall enter into a contract with the board of2-19
trustees of the school district located in the county served by the2-20
department for the provision and supervision of police services in the2-21
public schools within the school district and on property owned by the2-22
school district. The department shall create a separate unit designated as2-23
the school police unit for this purpose. 2. The department may establish different qualifications and training2-25
requirements for officers assigned to the school police unit than those2-26
generally applicable to officers of the department.2-27
Sec. 3. NRS 280.320 is hereby amended to read as follows: 280.320 1. A department is a local government employer for the2-29
purpose of the Local Government Employee-Management Relations Act2-30
and a public employer for the purpose of the Public Employees’2-31
Retirement Act.2-32
2. In negotiations arising under the provisions of chapter 288 of NRS:2-33
(a) The committee or two or more persons designated by it; and2-34
(b) The sheriff or a person designated by him,2-35
shall represent the department.2-36
3. In negotiations arising under the provisions of chapter 288 of2-37
NRS, the school police unit must be considered a separate bargaining2-38
unit.2-39
Sec. 4. On or before September 1, 1999, the board of trustees of a2-40
school district in a county that has a metropolitan police department2-41
created pursuant to chapter 280 of NRS shall transfer each school police2-42
officer employed by the school district to the metropolitan police2-43
department. Upon such a transfer, the metropolitan police department shall3-1
employ each such transferred employee and assign each such transferred3-2
employee to the school police unit within the department. The3-3
compensation and employment benefits provided to each employee so3-4
transferred must remain at least equal to that provided to him by the school3-5
district at the time of the transfer.3-6
Sec. 5. This act becomes effective on July 1, 1999.~
