AN ACT relating to law enforcement; requiring the boards of trustees of certain school

districts to employ a chief of school police; authorizing the boards of trustees of

certain school districts to contract with metropolitan police departments for police

services; authorizing the boards of trustees of certain other school districts to

contract with the county sheriff for police services; providing for the creation of a

school police unit within a metropolitan police department that has entered into a

contract with the board of trustees; and providing other matters properly relating

thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 391.100 is hereby amended to read as follows:

  1. 391.100 1. The board of trustees of a school district may employ a
  1. superintendent of schools, teachers and all other necessary employees.
  1. 2. The board of trustees of a school district:
  1. (a) May employ teacher aides and other auxiliary, nonprofessional
  1. personnel to assist licensed personnel in the instruction or supervision of
  1. children, either in the classroom or at any other place in the school or on
  1. the grounds thereof; and
  1. (b) Shall establish policies governing the duties and performance of
  1. teacher aides.
  1. 3. Each applicant for employment pursuant to this section, except a
  1. teacher or other person licensed by the superintendent of public instruction,
  1. must, as a condition to employment, submit to the school district a full set
  1. of his fingerprints and written permission authorizing the school district to
  1. forward the fingerprints to the Federal Bureau of Investigation and the
  1. central repository for Nevada records of criminal history for their reports
  1. on the criminal history of the applicant.
  1. 4. The board of trustees of a school district may employ or appoint
  1. persons to serve as school police officers. If the board of trustees of a
  1. school district employs or appoints persons to serve as school police
  1. officers, the board of trustees shall employ a law enforcement officer to
  1. serve as the chief of school police who is supervised by the
  1. superintendent of schools of the school district. The chief of school police
  1. shall supervise each person appointed or employed by the board of
  1. trustees as a school police officer. In addition, persons who provide
  1. police services pursuant to subsection 5 or 6 shall be deemed school
  1. police officers.
  1. 5. The board of trustees of a school district in a county that has a
  1. metropolitan police department created pursuant to chapter 280 of NRS,
  1. may contract with the metropolitan police department for the provision
  1. and supervision of police services in the public schools within the
  1. jurisdiction of the metropolitan police department and on property
  2. therein that is owned by the school district. If a contract is entered into
  1. pursuant to this subsection, the contract must make provision for the
  1. transfer of each school police officer employed by the board of trustees to
  1. the metropolitan police department. If the board of trustees of a school
  1. district contracts with a metropolitan police department pursuant to this
  1. subsection, the board of trustees shall, if applicable, cooperate with
  1. appropriate local law enforcement agencies within the school district for
  1. the provision and supervision of police services in the public schools
  1. within the school district and on property owned by the school district but
  1. outside the jurisdiction of the metropolitan police department.
  1. 6. The board of trustees of a school district in a county that does not
  1. have a metropolitan police department created pursuant to chapter 280
  1. of NRS, may contract with the sheriff of that county for the provision of
  1. police services in the public schools within the school district and on
  1. property therein that is owned by the school district.

Sec. 2. Chapter 280 of NRS is hereby amended by adding thereto a

new section to read as follows:

1. The department may enter into a contract with the board of

trustees of the school district located in the county served by the

department for the provision and supervision of police services in the

public schools within the school district and on property owned by the

school district. If the department enters into a contract pursuant to this

section, the department shall create a separate unit designated as the

school police unit for this purpose.

  1. 2. The department may establish different qualifications and training
  1. requirements for officers assigned to the school police unit than those
  1. generally applicable to officers of the department.

Sec. 3. NRS 280.320 is hereby amended to read as follows:

  1. 280.320 1. A department is a local government employer for the
  1. purpose of the Local Government Employee-Management Relations Act
  1. and a public employer for the purpose of the Public Employees’ Retirement
  1. Act.
  1. 2. In negotiations arising under the provisions of chapter 288 of NRS:
  1. (a) The committee or two or more persons designated by it; and
  1. (b) The sheriff or a person designated by him,
  1. shall represent the department.

3. In negotiations arising under the provisions of chapter 288 of

NRS, a school police unit must be considered a separate bargaining unit.

Sec. 4. This act becomes effective on July 1, 1999.
