THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 391.100 is hereby amended to read as follows: 391.100 1. The board of trustees of a school district may employ a1-3
superintendent of schools, teachers and all other necessary employees.1-4
2. The board of trustees of a school district:1-5
(a) May employ teacher aides and other auxiliary, nonprofessional1-6
personnel to assist licensed personnel in the instruction or supervision of1-7
children, either in the classroom or at any other place in the school or on1-8
the grounds thereof; and1-9
(b) Shall establish policies governing the duties and performance of1-10
teacher aides.1-11
3. Each applicant for employment pursuant to this section, except a1-12
teacher or other person licensed by the superintendent of public instruction,1-13
must, as a condition to employment, submit to the school district a full set1-14
of his fingerprints and written permission authorizing the school district to1-15
forward the fingerprints to the Federal Bureau of Investigation and the2-1
central repository for Nevada records of criminal history for their reports2-2
on the criminal history of the applicant.2-3
4. The board of trustees of a school district may employ or appoint2-4
persons to serve as school police officers. If the board of trustees of a2-5
school district employs or appoints persons to serve as school police2-6
officers, the board of trustees shall employ a law enforcement officer to2-7
serve as the chief of school police who is supervised by the board of2-8
trustees. The chief of school police shall supervise each person appointed2-9
or employed by the board of trustees as a school police officer. In2-10
addition, persons who provide police services pursuant to subsection 52-11
shall be deemed school police officers.2-12
5. The board of trustees of a school district in a county that has a2-13
metropolitan police department created pursuant to chapter 280 of NRS,2-14
may contract with the metropolitan police department for the provision2-15
and supervision of police services in the public schools within the2-16
jurisdiction of the metropolitan police department and on property2-17
therein that is owned by the school district. If a contract is entered into2-18
pursuant to this section, the contract must make provision for the2-19
transfer of each school police officer employed by the board of trustees to2-20
the metropolitan police department. If the board of trustees of a school2-21
district contracts with a metropolitan police department pursuant to this2-22
section, the board of trustees shall, if applicable, cooperate with2-23
appropriate local law enforcement agencies within the school district for2-24
the provision and supervision of police services in the public schools2-25
within the school district and on property owned by the school district but2-26
outside the jurisdiction of the metropolitan police department.2-27
Sec. 2. Chapter 280 of NRS is hereby amended by adding thereto a2-28
new section to read as follows:2-29
1. The department may enter into a contract with the board of2-30
trustees of the school district located in the county served by the2-31
department for the provision and supervision of police services in the2-32
public schools within the school district and on property owned by the2-33
school district. If the department enters into a contract pursuant to this2-34
section, the department shall create a separate unit designated as the2-35
school police unit for this purpose. 2. The department may establish different qualifications and training2-37
requirements for officers assigned to the school police unit than those2-38
generally applicable to officers of the department.2-39
Sec. 3. NRS 280.320 is hereby amended to read as follows: 280.320 1. A department is a local government employer for the2-41
purpose of the Local Government Employee-Management Relations Act2-42
and a public employer for the purpose of the Public Employees’ Retirement2-43
Act.3-1
2. In negotiations arising under the provisions of chapter 288 of NRS:3-2
(a) The committee or two or more persons designated by it; and3-3
(b) The sheriff or a person designated by him,3-4
shall represent the department.3-5
3. In negotiations arising under the provisions of chapter 288 of3-6
NRS, a school police unit must be considered a separate bargaining unit.3-7
Sec. 4. This act becomes effective on July 1, 1999.~
