THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 391.100 is hereby amended to read as follows: 391.100 1. The board of trustees of a school district may employ a1-3
superintendent of schools, teachers and all other necessary employees.1-4
2. The board of trustees of a school district:1-5
(a) May employ teacher aides and other auxiliary, nonprofessional1-6
personnel to assist licensed personnel in the instruction or supervision of1-7
children, either in the classroom or at any other place in the school or on1-8
the grounds thereof; and1-9
(b) Shall establish policies governing the duties and performance of1-10
teacher aides.1-11
3. Each applicant for employment pursuant to this section, except a1-12
teacher or other person licensed by the superintendent of public instruction,1-13
must, as a condition to employment, submit to the school district a full set1-14
of his fingerprints and written permission authorizing the school district to2-1
forward the fingerprints to the Federal Bureau of Investigation and the2-2
central repository for Nevada records of criminal history for their reports2-3
on the criminal history of the applicant.2-4
4. The board of trustees of a school district may employ or appoint2-5
persons to serve as school police officers. If the board of trustees of a2-6
school district employs or appoints persons to serve as school police2-7
officers, the board of trustees shall employ a law enforcement officer to2-8
serve as the chief of school police who is supervised by the2-9
superintendent of schools of the school district. The chief of school police2-10
shall supervise each person appointed or employed by the board of2-11
trustees as a school police officer. In addition, persons who provide2-12
police services pursuant to subsection 5 or 6 shall be deemed school2-13
police officers.2-14
5. The board of trustees of a school district in a county that has a2-15
metropolitan police department created pursuant to chapter 280 of NRS,2-16
may contract with the metropolitan police department for the provision2-17
and supervision of police services in the public schools within the2-18
jurisdiction of the metropolitan police department and on property2-19
therein that is owned by the school district. If a contract is entered into2-20
pursuant to this subsection, the contract must make provision for the2-21
transfer of each school police officer employed by the board of trustees to2-22
the metropolitan police department. If the board of trustees of a school2-23
district contracts with a metropolitan police department pursuant to this2-24
subsection, the board of trustees shall, if applicable, cooperate with2-25
appropriate local law enforcement agencies within the school district for2-26
the provision and supervision of police services in the public schools2-27
within the school district and on property owned by the school district but2-28
outside the jurisdiction of the metropolitan police department.2-29
6. The board of trustees of a school district in a county that does not2-30
have a metropolitan police department created pursuant to chapter 2802-31
of NRS, may contract with the sheriff of that county for the provision of2-32
police services in the public schools within the school district and on2-33
property therein that is owned by the school district.2-34
Sec. 2. Chapter 280 of NRS is hereby amended by adding thereto a2-35
new section to read as follows:2-36
1. The department may enter into a contract with the board of2-37
trustees of the school district located in the county served by the2-38
department for the provision and supervision of police services in the2-39
public schools within the school district and on property owned by the2-40
school district. If the department enters into a contract pursuant to this2-41
section, the department shall create a separate unit designated as the2-42
school police unit for this purpose.3-1
2. The department may establish different qualifications and training3-2
requirements for officers assigned to the school police unit than those3-3
generally applicable to officers of the department.3-4
Sec. 3. NRS 280.320 is hereby amended to read as follows: 280.320 1. A department is a local government employer for the3-6
purpose of the Local Government Employee-Management Relations Act3-7
and a public employer for the purpose of the Public Employees’ Retirement3-8
Act.3-9
2. In negotiations arising under the provisions of chapter 288 of NRS:3-10
(a) The committee or two or more persons designated by it; and3-11
(b) The sheriff or a person designated by him,3-12
shall represent the department.3-13
3. In negotiations arising under the provisions of chapter 288 of3-14
NRS, a school police unit must be considered a separate bargaining unit.3-15
Sec. 4. This act becomes effective on July 1, 1999.~
